Minutes of JCM Staff Side Meeting with 7th CPC Implementation Cell held on 19.2.2016

Minutes of JCM Staff Side Meeting with 7th CPC Implementation Cell held on 19.2.2016

Minutes of the Meeting of Joint Secretary (IC) with the Members of the Staff-Side of the Standing Committee (National Council-JCM) held on 19.02.2016

A Meeting was held under the chairmanship of Joint Secretary (Implementation Cell), Department of Expenditure, Ministry of Finance, with the Members of the StaffSide of the Standing Committee (National Council-JCM) on 19.2.2016 to discuss the issues raised by the National Joint Council of Action (NJCA) {Joint Consultative Machinery (JCM)} in their letter No. NJC/2015/7th CPC dt. 10.12.2015, addressed to the Cabinet Secretary, regarding their Charter of Demands on the recommendations of the 7th Central Pay Commission. The Secretary, Staff-Side of the Standing Committee (National Council- JCM), who is the convener of the NJCA, along with other office bearers attended the meeting. The list of the participants from the Staff-Side is attached at Annexure.

2. Welcoming the members of the Staff-Side, JS(IC) mentioned that the meeting has been convened to enable the Staff-Side to bring out their concerns on the recommendations of the 7th CPC in the light of the Charter of Demands made by them in the aforesaid letter of NJCA so that same could be examined in the Implementation Cell and submitted for consideration of the Empowered Committee of Secretaries. He informed the office bearers that before arriving at a decision, the ECoS would also hold separate discussions with the Staff Side.

2. Commencing the discussions from the Side of the Members of the Staff-Side, Secretary, Staff-Side, Standing Committee (National Council-JCM), explained that they have already placed their Charter of Demands as per the letter of NJCA dated 10.12.2015. He mentioned that the reasons based on which these demands have been made have also been explained therein. He, however, highlighted that the Staff-Side is not at all happy with the recommendations of the 7th CPC and, in fact, no section of the employees is satisfied, as the Commission has recommended a minimal pay increase as compared to the previous Pay Commissions. He mentioned that the Staff-Side does not agree with the minimum pay of Rs. 18000 and the reason as to why the methodology adopted by the 7th CPC to arrive at this figure is not correct has been explained in their letter dated 10.12.2015. He stated that Staff-Side demands enhancement of the minimum pay to Rs. 26000 and the reasons in support of this have been given in their aforesaid letter. He further stated that an amicable and mutually negotiated settlement of these demands is necessary as non-acceptance would further cause resentment in the employees. He informed that Staff-Side has already made their stand clear to go on strike from 11th April, 2016 if their demands are not considered and no amicable settlement happens.

3. Thereafter, the other members of the Staff-Side also expressed their arguments for acceptance of these demands and all of them emphasised that the minimum pay needs to be revised. Consequently, the fitment multiple of 2.57 would also need commensurate change. The leader of the Staff-Side explained that the office bearers who were present in the meeting represent various sections of Central Government employees including railways, defence civilians, postal employees etc., the number of which is around Rs. 32 lakhs.

4. The Staff-Side brought out their concerns on all the 26 demands included in the Charter of Demands and all the points brought out by them in the letter of the NJCA dt. 10.12.2015 were reiterated. However, following issues in support of their demands were highlighted :-

(i) Minimum Pay needs to be revised to Rs. 26000 p.m. and the minimum pay of Rs. 18000 p.m. as recommended by 7th CPC is not acceptable. This would require upward revision in the fitment multiple of 2.57 and change in the Pay Matrix. It was argued that if the 10% of the pay for NPS contribution and the recommended increase in the CGEIS contribution are taken into account, there would be a drop in the take-home salary of the employees at the
minimum pay of Rs.18000.

(ii) Central Government employees need to be excluded from the National Pension Scheme (NPS), which has been a long pending demand of the StaffSide. The Staff-Side stated that the Pension Fund which has been created under NPS to generate annuity for employees, would not ensure reasonable pension. Rather it is quite likely that it may generate negative returns because of the dismal performance of the financial market to which the fund is
invested, leaving the employees without any reasonable social security benefit.

(iii) The 7th CPC has recommended abolition of 52 allowances without properly appreciating the justification of these allowances. The example of break-down allowance in case of Railway employees was given, stating that this allowances is given so that the concerned employees take up the necessary follow up action in the case of breakdown on an urgent basis and therefore its withdrawal is not justified in operational interests of Railways.

(iv) The withdrawal of advances, especially LTC, TA, Medical, National Calamity Advance, was not justified. It was argued that these advances are recovered from the employees and, therefore, the same should be retained. (v) In regard to enhancement of contribution under Group Insurance Scheme, it was argued that increase in the contribution from the employees was not justified and if the same is to be raised, the Government should bear the
insurance premium.

(vi) The post of LDC should be upgraded to UDC and as part of delayering, Grade Pays of Rs. 1900, Rs. 2400 and Rs. 4600 should be abolished and merged with the next higher Grades.

(vii) The rate of increment needs to be raised from 3% to 5% because pay is revised in the Central Government after 10 years. It was mentioned that in the PSUs the pay is revised after 5 years and the rate of increment is also higher.

(viii) Two increments in the feeder post may be granted as promotion benefit.

(ix) Fixed medical allowance for pensioners who are not covered by CGHS and REHS needs to be increased from Rs. 500 p.m. to Rs. 2000 p.m.

(x) The recommendation regarding grant of only 80% of salary for the second year of Child Care Leave need not be accepted and the existing provisions may be retained

(xi) It was also demanded that though the D/o Expenditure has sought the comments of the Ministries/Department on the issues pertaining to them after consulting the Staff Associations, administrative Departments are not inviting the Staff associations for discussions.

5. After detailed explanation by the Staff-Side on all the demands included in the Charter of Demands, JS(IC), while concluding the discussions, assured the Staff-Side that the concerns and demands made by them would be placed before the Empowered Committee of Secretaries for consideration after examining the same in the light of the recommendations of the Commission. He also mentioned that in cases where the comments of the administrative Ministries/ Departments would be necessary, e.g., the case of break-down allowance pertaining to Ministry of Railways, the same would be considered before the issues are placed before the E-CoS. As regards the issue raised that the administrative Departments are not inviting staff associations for discussions, JS(IC) mentioned that the Departments have to formulate the views keeping in view the representations made by the Staff Associations.

6. Thereafter, the meeting ended with thanks to the chair.

7th CPC Recommendations : Upgradation of GP 4200, 4600 and 4800 for the Employees of the Supreme Court

7th CPC Recommendations : Upgradation of GP 4200, 4600 and 4800 for the Employees of the Supreme Court

Officers and Employees of the Supreme Court : Upgradation of Pay in Selected Posts in Existing GP 2800

Upgradation of pay has been sought for the group of posts in the present pay scale with GP 2800 to GP 4200. These include Junior Court Assistant, Chauffer, Special Process Server, Restorer Gr. I /Library Attendant Gr. I/Gestetner Operator Gr. I.

Analysis and Recommendations : The Commission has noted the recommendations made by the Committee of Judges in this regard. The Committee of Judges after examination of demands made has pointed out that in view of basic qualification, nature of duties and degree of efficiency, integrity and confidentiality the post of Junior Court Assistant can be considered for an upgradation in pay.

The Commission further notes that the educational qualifications for direct recruitment to the post of Junior Court Assistant is a degree from a recognised University and knowledge of computer operations with a stipulated typing speed in computers. The information furnished to the Commission with respect to the Recruitment Rules of various posts also indicates that in all other posts carrying a GP 2800 the educational qualifications is lower than graduation and therefore equating Junior Court Assistants with these posts would not be correct. In view of the foregoing the Commission is in agreement with the views of the Committee of Judges. Accordingly, the Commission recommends upgradation in the pay for the post of Junior Court Assistant to GP 4200 from the existing GP 2800.

Upgradation of Pay in Selected Posts in Existing GP 4200

For the group of posts covering Court Assistant, Personal Assistant, Accountant, Cashier, the Association requested pay parity with the holders of analogous/equivalent posts in the High Court of Delhi, who are drawing pay with GP 4600.

Analysis and Recommendations : The Commission has noted the recommendations made by the Committee of Judges in this regard. The Committee of Judges, after examination of demands made, agrees with the recommendation of upgradation in pay to conform to the pay of the holders of analogous posts in the High Court of Delhi.

The Commission recognises that the Supreme Court is at the apex of the hierarchy of Courts in India and hence its personnel should not be disadvantageously placed vis-à-vis the High Court of Delhi.

Accordingly, the Commission recommends upgradation for the post of Court Assistant, Personal Assistant, Accountant and Cashier to GP 4600 from the existing GP 4200.

Upgradation of Pay in Selected Posts in Existing GP 4600

Upgradation of pay has been sought for pay of the group of posts in the present GP 4600 to GP 4800. These include posts of Private Secretary to Additional Registrar, Sr. Personal Assistant, Senior Court Assistant, Court Associate, Editor of Paper books, Assistant Librarian,
Proof Reader, Assistant Accounts Officer (Concurrent Audit) and Building Supervisor. The justification for upgradation is that the holders of analogous posts in the High Court of Delhi are in GP 4800.

Analysis and Recommendations : The Commission has been informed that the Committee of Judges, after examination of demands made, have endorsed the upgradation in pay to conform with the pay of the holders of analogous posts in the High Court of Delhi.

The Commission recognises that the Supreme Court is at the apex of the hierarchy of Courts in India and hence its personnel should not be disadvantageously placed vis-à-vis the High Court of Delhi. Accordingly, the Commission recommends upgradation in the pay for the post of Private Secretary to Additional Registrar, Sr. Personal Assistant, Senior Court Assistant, Court Associate, Editor of Paper Books, Assistant Librarian, Proof Reader, Assistant Accounts Officer (Concurrent Audit) and Building Supervisor to GP 4800 from the existing GP 4600. However on completion of four years approved service further non-functional upgrade to GP 5400 (PB-2) is also recommended for these posts.

Decrease in Take Home Salary from 6th to 7th Pay Commission – IRTSA

Decrease in Take Home Salary from 6th to 7th Pay Commission – IRTSA

7thCPC PAY HIKE – IS IT A HIKE OR A FARCE ?
THE CAUSE IS HIDDEN
THE EFFECT IS VISIBLE TO ALL

7th CPC has submitted its report to the Government and the additional expenditure projected by the PAY Commission is of 1.02 lakh rupees. As outsiders many of the country men started crying hoarse that the Govt. employees are taking away lions’ share of its income.

Out of the projected 1.02 lakh hike, just above 1/4th is going to be borne by Indian Railways within its own budget; centre has to bear 1/4th towards pension, 1/4th towards allowances and only 1/4th towards Pay. Govt. need to borne only Rs.27,750 crores towards increase in pay. Allowances need not be taken as higher expenditure since they are part of compensation towards inflation and expenditure incurred in discharge of official duties.

7th CPC itself observed that financial impact on account of increase in pay, allowances & pension will be 23.55%. Increase on account of Pay & DA (excluding other allowances) will be to the tune of 16%. At present, without implementing 7th CPC Report, Year on year increase in the expenditure in both pay and pension has averaged about 11% of the Central Expenditure. Thus real increase on account of increase in pay, all allowances & pension will be only 12.55% (23.55% – 11% = 12.55%). Real increase on account of Pay & DA will be only 5% (16% – 11% = 5%).

IS THERE A REAL INCREASE IN TAKE HOME PAY?
Real increase in minimum wage between 6th CPC & recommended 7th CPC scales will be Rs.2250. Employees’ contribution to National Pension scheme will increase from Rs.700 to Rs.1800 and for CGEGIS it will increase from present Rs.30 to Rs.1500. Therefore increase in real wage (take home pay) of Rs.2250 will be eaten away by Rs.900 increased contribution for NPS plus Rs.1500 for CGEGIS. Net take home pay will have a negative growth of Rs.320 (Rs.1100 + Rs.1470 – Rs.2250 = Rs. – 320) as illustrated in the table below:

WILL THERE BE ANY ADDITIONAL EXPENDITURE DUE TO PAY HIKE RECOMMENDED BY 7TH CPC?
Government will take back into its treasury Rs. 6500 crores from increased monthly contribution towards CGEGIS and another Rs.2500 crores towards employees’ contribution for NPS from 11 lakh employees appointed after 1.1.2004. After reducing Rs.9000 crore from Rs.27,750 crore (projected increase in pay), net additional expense towards Pay will be around Rs.18,750 crores only. Even this additional expenditure is not true.

Total Expenditure on Pay & Allowance in FY 2012- 13 was Rs.1,29,599 crore. If it is indexed by 11% increase year on year, in the FY 2015-16 even without implementing 7th CPC recommendations increase on account of Pay & Allowances will be around Rs.19,500 crore. Therefore Government is not going to have any additional expenditure on account of Pay increase after the implementation of 7th CPC Report as per its recommendations.

For 2012-13, revenues foregone through various concessions to various sections are estimated at a total of Rs.5,73,627 crore which was 10 per cent higher than the total fiscal deficit of the Central Government, financial experts say, concessions must be given to have accelerated economic growth. Government employees are exposed to negative growth in their real wage – but who cares?

The 7th CPC had kindled such a great curiosity among the employees – CGE Portal

The 7th CPC had kindled such a great curiosity among the employees – CGE Portal

7TH CPC: CENTRAL GOVT EMPLOYEES EXPECTATIONS AND HAPPY NEW YEAR 2016

That the 7th Pay Commission which was eagerly expected by all the Central Government Employees submitted its recommendations to the Finance Minister on 19/11/2015 would have been known to almost all the employees.

This is because all the popular websites, blogs, newspapers and TV channels flashed news about the pay commission. It is a crucial announcement which benefits 45 lakh employees and 50 lakh pensioners and so the websites and blogs had a tough time to handle lakhs of visitors who visited them at the same time.

The 7th CPC had kindled such a great curiosity among the employees. When the 6th CPC announcement was made it did not receive such a wide publicity. Since the past eight years, the internet usage has increased tremendously.

In the same way, we can say that when the 8th CPC is announced even the way it is announced might change completely. To that extent the use of online applications are increasing rapidly.

Today, it is very common to find almost all the employees carrying Android cell phone in their hands and having a Desktop or a Laptop in their homes. Using these gadgets they performed a massive number of searches on 7th CPC.

The searches performed by the users tried to find answers for questions like: How the Basic Pay has changed? Is there still a system of Grade Pay? What happened to HRA? What is the status of CEA?

However, after seeing the 7th CPC report, the employees were in a state of disappointment as they did not get what they had expected. Most of the employees felt that they did not get benefits and pay increase in 7th CPC as they got when the pay commission changed from 5th to 6th. The faces of most of the employees were sad because the rise that they got occurs only once in ten years.

All federations expressed their disapproval through reports. Through the NJCA agency, they have decided to go on an indefinite strike in the month of March.

In this scenario, the new years is beginning on 01/01/2016. The employees who had planned to enjoy the New Year in a grand way along with the announcement of 7th CPC in are pushed to a state of grief as they heard the news that they have to compulsorily come to work on 01/01/2016 failing which their pay revision will happen from the date they came for work lastly.
News such as these has put a big question mark on their New Year celebrations. In many Central government offices, the holiday that was already announced for the New Year day has been changed to some other day.

They say this change has been done to avoid unnecessary problems that may arise in the Revision of Pay. However, after the New Year day, we get a Saturday and Sunday, so we can hope that the New Year celebrations will happen in a glorious manner on these two days.

National Council JCM and Confederation described it as Retrograde recommendations, unexpected and unacceptable

NC JCM and Confederation described it as retrograde recommendations, unexpected and unacceptable

Central Government need to pay attention to the flaws of the 7th Pay Commission report

The statistics reveals that there are 88% of total strength of Government servants are in Group ‘C’ Category.

Obviously those who are representing these 88% at the Forums which are constituted to negotiate with concerned Departments and Government about their issues are capable of weighing the advantages and disadvantages of recommendations of 7th central pay commission.

The Staff Associations and Workers federations are the one who are representing Group C and Group B at various levels of negotiating forums know the plights and facts of government servants more than anybody. They in fact never utter a word of praise on 7th CPC recommendations since the day the report was submitted to the Finance Minister.

National Council JCM and Confederation described it as Retrograde recommendations, unexpected and un acceptable. They declared that all the central government employees are upset and dis satisfied since many of their demands were not considered by 7th pay commission.

1. Pay Scales and allowances are arrived by multiplying 2.57, just 14.29 % increase over existing pay and Allowances after DA neutralization.
2. The rate of HRA has been abruptly reduced,
3. Payment of CCL has been reduced for second 365 days.
4. Same confusion in MACP continues,
5. Uncertainty in Pension benefit in NPS continues.
6. Existing Pension provisions are left un touched. None of the proposals submitted by Pensioners Associations are not considered.
7. Minimum Pay is very much less; Maximum Pay is lavishly higher. [Minimum Rs.18000 – Maximum Rs.275000]
8. Gap between Minimum and Maximum Pay is not reduced, but unfortunately increased. [In sixth CPC it is 1:12 , 7th CPC Recommends 1:14]
9. All the Pay commission reduced the number of pay scales but 7th Pay commission maintained the existing pay scales,
10. 55 Allowances are abolished, No new allowances are introduced,
11. Same 3% increment continues, NCJCM demand for Two Increment Days 1st January and 1st July is not considered
12. No considerable benefit on Promotion,
13. Interest free advances including LTC advance are abolished,
14. Except the introduction of New Pay Matrix, nothing new in the recommendations of 7th Pay commission
15. Again uniform Multiplication factor was not applied for arriving Entry Pay for various Grades.

Low value for Lower Grades high value for higher Grades. Again the disparity in arriving Entry Pay is maintained by 7th CPC also.

What sixth CPC had recommended in some cases, what Government has suggested in some issues, what the Department has told, that has been just followed by the 7th Pay commission.
So the Central government employees are expecting the Government to pay attention to the concerns of Govt servants in respect of some recommendations of 7th pay commission which need to be addressed to boost the morale of the Central Govt staffs.

The constituents of NCJCM already formed National Joint Council of Action (NJCA) to invite the attention of Central Government through agitation Programmes to settle their demands. Now they modified their charter of demands to include the issues regarding 7th Pay Commission recommendation and cautioned that unless it is not settled before March 2016, they will be going for indefinite Strike.

Person With Disabilities in Central Government – 7th Pay Commission Recommendations

Person With Disabilities in Central Government – 7th Pay Commission Recommendations

PWDs in Central Government

The government provides three percent reservation in jobs for PWDs. Apart from this reservation at the entry stage, DoPT has issued instructions regarding identification of jobs, post-recruitment and pre-promotion training, providing aids/assistive devices, accessibility and barrier free environment at work place, preference in government accommodation, grievance redressal, and preference in transfer/posting for PWDs. In a recent notification, a provision has been made for ten years’ (fifteen years in case of SC/ST and thirteen years in case of OBC candidates) relaxation in the upper age limit for direct recruitment to civil posts/services under the Central Government.

Moreover, there are certain special entitlements as given below:
i. Special Allowance for Child Care for Women with Disabilities at the rate of ₹1,500 pm;
ii. Transport Allowance at double the normal rate, subject to a minimum of ₹1,000 pm;
iii. Constant Attendance Allowance for retired employees with 100 percent disablement at the rate of ₹4,500 per month;
iv. Special Casual Leave for four days in a calendar year for specific requirements relating to disabilities;
v. Special Casual Leave for ten days in a calendar year for participation in Conferences/Seminars/Trainings/Workshops related to disability and development.

In case the disability is work related, the following additional provisions are available:
a. Special Disability Leave;
b. Disability Pension;
c. Educational Concession to children of Defence personnel who are disabled in action.

For employees with differently abled children, Children Education Allowance and Hostel Subsidy is granted at double rate.

Demands
Associations of employees with disabilities made the following demands before the Commission:
i. Suitable enhancement in the existing provisions
ii. Provision of Common Room in offices with suitable recreational facilities
iii. Additional rebate in House Building Advance and Automobile Advance
iv. Establishment of Welfare Committees in the ministries

Analysis and Recommendations
The National Policy for Persons with Disabilities, 2006, enunciates the measures that need to be taken by the government to ensure equal opportunities, protection of justifys and full participation in society for PWDs, in consonance with the principles enshrined in the Indian Constitution. India is also a signatory to the UN Convention on the justifys for Persons with Disabilities. Thus, provision of appropriate measures for employees with disabilities is the responsibility of the Union Government.

The Commission has made various recommendations regarding PWDs at different places in the report. They are consolidated here for ready reference:
i. In recognition of the singular responsibility faced by differently abled women in raising their children, the Special Allowance for Child Care for Women with Disabilities has been enhanced from the present rate of ₹1,500 pm to ₹3,000 pm

ii. Transport Allowance at double the normal rate has been retained, and the minimum amount has been increased from ₹1,000 pm to ₹2,250 pm

iii. Children Education Allowance and Hostel Subsidy have been kept at double rate for differently abled children

iv. Constant Attendance Allowance has been enhanced from ₹4,500 pm to ₹6,750 pm

v. Special Disability Leave has been subsumed in Work Related Illness and Injury Leave (WRIIL), with improved provisions

vi. Educational Concession, hitherto available only to the children of Defence personnel killed/missing/disabled in action, has been extended to similarly placed personnel of CAPFs, Indian Coast Guard, RPF and police forces of Union Territories mutatis mutandis.

Besides the above recommendations, there are a few suggestions that can go a long way in improving the working environment for these employees:

i. In our interactions, it has been highlighted that easy access, particularly to toilets, remains an issue of concern. Hence, it is suggested that Guidelines and Space Standard for Barrier Free Built Environment for Disabled and Elderly Persons, issued by CPWD, Ministry of Urban Affairs and Employment, should invariably be followed while designing new government premises. Their application in the existing offices may also be explored.

ii. Every ministry should have a Welfare Committee, with due representation of differently abled employees, to address their concerns.

iii. The grievance redressal machinery should be strengthened and made more effective

7th CPC Report on Fixed Medical Allowance

7th Pay Commission report on Fixed Medical Allowance

Fixed Medical Allowance

It is granted to pensioners for meeting expenditure on day to day medical expenses that do not require hospitalization, presently payable at the rate of ₹500 pm. Demands have been received to increase the rate of this allowance to ₹2,000 pm.

Pensioners are not covered under the CS (MA) Rules. Pensioners residing outside CGHS areas are entitled to Fixed Medical Allowance (FMA) @ ₹500 per month for their OPD/IPD needs. Such pensioners can also avail IPD/OPD under CGHS subject to some conditions.

Analysis and Recommendations : The Commission notes that this allowance was enhanced from ₹300 pm to ₹500 pm from 19.11.2014.

As such, further enhancement of this allowance is not recommended.

The Commission has received representations seeking enhancement in Fixed Medical Allowance, currently payable at the rate of ₹500 per month for pensioners not covered under Central Government Health Service (CGHS).

7th Pay Commission Report on Enhancement of ceiling of Earned Leave for purposes of Leave Encashment

7th Pay Commission Report on Leave Encashment of EL

Enhancement of ceiling of Earned Leave for purposes of Leave Encashment

The Commission has received representations seeking raising the ceiling limit of 300 days to 450 days for purposes of Leave encashment.

Analysis and Recommendations : The Commission notes that based on the recommendations of the VI CPC, serving employees are entitled for encashment of Earned Leave up to 60 days while in service. This is not to be deducted from the maximum number of Earned Leave of 300 days encashable at the time of retirement. The VI CPC, therefore, has further liberalised the regime of leave encashment.

The recommendations in relation to pay of both the civilian and defence forces personnel will also lead to a significant increase in the pay drawn and therefore in the total amount of leave encashment available for an employee.

Therefore raising the present ceiling of 300 days is not recommended by the Commission.

Analysis and Recommendations of Reduction in the time period for Restoration of Basic Pension

Reduction in the time period for Restoration of Basic Pension

The Commission has received a number of representations requesting reduction of restoration period of commuted portion of pension from the existing 15 years.

Analysis and Recommendations : The Commission notes that prior to V CPC the commutation allowed was one-third. However, there was no restoration. The Supreme Court, vide their judgement dated 09.12.1986, allowed restoration of pension after 15 years. The Supreme Court in its judgement specifically stated that though the amount is recovered in 12 years, yet since there is a risk factor and some of the states are restoring pension after 15 years, the period of restoration is fixed at 15 years. The V CPC in its recommendation increased the percentage of commutation to 40 percent and recommended restoration period at 12 years. But the reduction of restoration period was not accepted by the government. The VI CPC did not recommend any change in the maximum percentage of commutation allowed or in the period of restoration.

This Commission also does not recommend any change either in the maximum percentage of commutation or in the period of restoration.

7th Pay Commission Report - Rationalisation of Death Gratuity

Rationalisation of Death Gratuity by 7th Pay Commission

The Commission has received representations pointing to a need for rationalization of current slabs for death gratuity, especially for the slab of 5 to 20 years of qualifying service in which family pensioners are stated to be placed at a disadvantageous position.

Analysis and Recommendations : As per Rule 50 of Pension Rules, the death gratuity admissible will be as follows, subject to the maximum limit prescribed for the gratuity:

Authority: 7th CPC Report

7th Pay Commission recommends enhancement in the ceiling of gratuity from the existing ₹10 lakh to ₹20 lakh from 01.01.2016

7th CPC increased Gratuity Ceiling limit – 20 lakh from 1.1.2016

Enhancement in the Gratuity Ceiling and its Indexation

The Commission recommends enhancement in the ceiling of gratuity from the existing ₹10 lakh to ₹20 lakh from 01.01.2016.

A number of representations have been received by the Commission stating that there is a need to revise the existing ceiling of ₹10.00 lakh with regard to payment of service gratuity.

Analysis and Recommendations : Rule 49 and 50 of the CCS (Pension) Rules provides that a government servant is entitled to get retirement gratuity equal to one-fourth of his emoluments for each completed six monthly period of qualifying service subject to a maximum of 16.5 times of the last emoluments subject to a maximum of ₹10 lakh.

The Commission sought the views of the government in this regard. The Department of Pension and Pensioners Welfare stated that the VI CPC has increased the amount of gratuity from ₹3.5 lakh to ₹10 lakh w.e.f. 01.01.2006. This amount, in the view of the department, is not commensurate with emoluments that are available to senior officers at the time of retirement. The department has suggested to the Commission that a view could be taken to index gratuity with amount of DA admissible at the time of retirement.

The Commission notes that there is merit in the argument advanced to index the ceiling on gratuity so that the benefits of the enhanced ceiling are available to personnel in a manner which is more even over a time frame.

The Commission recommends enhancement in the ceiling of gratuity from the existing ₹10 lakh to ₹20 lakh from 01.01.2016. The Commission further recommends, as has been done in the case of allowances that are partially indexed to Dearness Allowance, the ceiling on gratuity may increase by 25 percent whenever DA rises by 50 percent.

7th Pay Commission Recommendations on Health Insurance Scheme

7th Pay Commission Recommendations on Health Insurance Scheme

Health Insurance Scheme : In this backdrop, the Commission opines that health insurance for the government employees and pensioners remains the most optimal route for ensuring complete coverage for all employees, pensioners and their dependants in the long run. The IV CPC had suggested that feasibility and modalities of an Insurance Scheme for government employees in lieu of medical reimbursement may be considered by the government.

The VI CPC had recommended introduction of a health insurance scheme for Central Government employees and pensioners. It had recommended that for existing employees and pensioners, the scheme should be available on a voluntary basis, subject to their paying the prescribed contribution. It had also been recommended that the health insurance scheme should be compulsory for new government employees who would be joining service after the introduction of the Scheme.

Similarly, it had recommended that those retiring after the introduction of the insurance scheme would be covered under the Scheme.

The Commission observes that in view of the recommendations of the earlier Pay Commissions and various high power committees, the government has been contemplating the introduction of a health insurance scheme on Pan-India basis. The Commission notes that although the Committee of Secretaries had given its ‘in principle’ approval way back in 2011, and an amount of ₹ 2,061 crore had been earmarked under the XII Five Year Plan, the Scheme has still not been implemented.

The Commission notes that given the tardiness in the introduction of the long awaited Insurance Scheme, as already mentioned earlier in this chapter, the pensioners residing outside CGHS area will continue to be at a disadvantage, in terms of medical facilities, compared to their counterparts residing in CGHS areas. As stated earlier in this chapter, according to existing provisions, pensioner residing outside CGHS area but subscribing to CGHS for OPD/IPD can avail medical facility from any hospital–private or public or empanelled under CS (MA)/ECHS–in his/her own city. However, in such cases, the pensioners have to make upfront payment to the hospital and claim reimbursement later. The Commission feels that this could be a limiting factor for many pensioners who may not have the resources to pay hospital expenses upfront. The Commission notes that under CS (MA) Rules/ECHS, there are empanelled hospitals in every part of the country, at least in all major locations. In this backdrop, after identification of some major centres/cities based on minimum population threshold of pensioners, these hospitals could be empanelled by CGHS as well, for extending
medical facilities on a cashless basis.

Considering all the issues, the Commission makes the following recommendations:

i. The Commission strongly recommends the introduction of health insurance scheme for Central Government employees and pensioners. In the interregnum, for the benefit of pensioners residing outside the CGHS areas, the Commission recommends that CGHS should empanel those hospitals which are already empanelled under CS (MA)/ECHS for catering to the medical requirement of these pensioners on a cashless basis. This would involve strengthening of administrative capacity of nearest CGHS centres. However, this step will go a long way in ameliorating the pending grievances of these pensioners.

ii. The Commission recommends that the remaining 33 postal dispensaries should be merged with CGHS. The Commission further recommends that all postal pensioners, irrespective of their participation in CGHS while in service, should be covered under CGHS after making requisite subscription.

iii. Currently, there are various health care schemes in the Central Government catering to specific sets of employees. For example, apart from CGHS, there are Ex-Servicemen Contributory Health Scheme (ECHS) and Railways Employees Liberalized Health Scheme (RELHS) which cover ex servicemen and Railway employees/pensioners, respectively. Although the patterns in these schemes vary, a combined entity of CGHS ECHS-RELHS
would result in a very strong network of health facilities for the Central Government employees across the length and breadth of the country. The Commission recommends that possibility of such a combined network of various medical schemes should be explored through proper examination.

Based on the recommendations of the VI CPC, the Government has been contemplating introduction of a Health Insurance Scheme. The Commission observes that there are many global health care insurance companies today who provide comprehensive health care coverage. Through suitable tie ups with these companies, the government may examine the possibility of enhancing the remit of the proposed Health Insurance Scheme to include all the officers/staff and their dependents posted in Embassies/Missions abroad. Needless to state, this should be preceded by a thorough examination of the annual costs involved under the AMA Scheme vis-à-vis likely annual cost under the insurance route.

Subject: Views/Comments of BPMS on the recommendations of 7th CPC.
Reference: Your letter No. 11(4)/2015-D(CIV-I), Dated 04.12.2015

Respected Sir,
With due regards, it is submitted that this federation has gone through the recommendations of 7th CPC and found that the recommendations are very disappointing. It appears that the 7th CPC has not considered the genuine demands of the Government employees including Civilians in Min of Defence in correct perspective. Report of 7th Central Pay Commission has led the Group ‘C’ employees in huge discontentment because 5th CPC and 6th CPC had already granted less financial benefit to the incumbents of Group ‘C’ in comparison to Group ‘A’ and Group ‘B’. Group ‘C’ employees were very much hopeful that this Pay Commission would do something better for them but non-fulfillment of their hope by 7th CPC has led Group C employees in discontentment. A few points are being put before Ministry of Defence with an expectation that it will do justice to Group ‘C’ employees.

The points are as under-

1. The ratio of minimum and maximum pay (Secretary level, not Cabinet Secretary) was 1:10.66 in 4th CPC. Further it was 1:10.19 in 5th CPC and 1:11.42 in 6th CPC. 7th CPC has extended it to 1:12.5 whereas it had been recommended in previous Pay Commissions the ratio of minimum and maximum pay should not exceed 1:8. The pay scale of officers of Secretary level has been recommended Rs 2,25,000/- and minimum pay has been recommended Rs18,000/-. You are requested to reduce this wide gap by enhancing the minimum pay to Rs 24,000/- from the proposed Rs. 18000/-

2. 6th CPC had granted more benefit to Group A and Group B officers as it had merged the Pay Scale of (5000-8000) and (5500-9000) and upgraded to Rs (6500-10500) and the pay scale of Rs. (6500-10500) and (7450-11500) had been merged, whereas none of the Pay Scales of Group C had been merged nor upgraded. It was expected to 7th CPC that it would grant some relief by merging and upgrading the Pay Scale of Group ‘C’ employees. But it did not happen. Educational qualification has been raised with respect to Pay Scale of Group C employees but Pay Scales have not been upgraded. You are requested to grant new Pay Scale of 7th CPC related to Grade Pay 2400/- by merging Grade Pay 1900 and Grade Pay 2000 and upgrading these scales to 2400/- so that Lower Division Clerks, Store Keepers, Skilled Industrial Employees, Firemen etc. may get justice. Further, new pay scale of 7th CPC related to GP 2800/- should be granted to the incumbents (like UDC, Stenographers etc.) by upgrading Grade Pay 2400/- to Grade Pay 2800/- to get justice.

3. Fitment Formula:- This CPC also applied higher Multiplying Factor of 2.72 & 2.81 for higher authorities like PB-4 whereas this has been fixed as 2.57 for PB-1 & 2.62 for PB-2. There must be uniformity in the Multiplying Factor. Further, to achieve the enhanced Minimum Pay Rs. 24000/- the Fitment formula for PB-1 & 2 should be fixed at 3.42 in place of 2.57.

4. Annual increment has been recommended 3% again, it should be enhanced to 5%. Employees are not getting their annual increment even after completing 12 months because 6th CPC has fixed July month for annual increment for all employees. They get their annual increment between 13 months and 17 months. This anomaly should be removed. The employee must be granted his annual increment just after completing 12 months from the enrollment date.

5. Modified Assured Career Progression:- 5th CPC had recommended for two financial up-gradation in the promotional hierarchy on completion service of 12 years and 24 years respectively that had been implemented by the Government from the dated: 09/08/1999. But 6th CPC had recommended for 3 financial upgradations in next Grade Pay after completing 10, 20 and 30 years of service respectively. Government granted these up-gradations in next Grade Pay in place of next Promotional Grade Pay and reduced the benefit given by the earlier government. Therefore, you are requested to issue necessary directives to implement MACP for granting next Promotional Pay Scale in place of immediate next level in the hierarchy.
Further, 5 financial upgradations under the MACP Scheme should be granted in place of 3 upgradations within service of 30 years. 07th CPC has upgraded the benchmark of Very Good in place of Good for grant of MACP which is not acceptable, hence, it should be retained Good.

6.  Allowances: – 7th CPC has recommended for abolishing 52 Allowances. To abolish Washing Allowance & Risk Allowance, Family Planning Allowance is very unfortunate. Risk Allowance covers those situations where the risk is inherent and continuous in the occupation itself with adverse effect on the health. Risk Allowance is presently given to employees engaged in hazardous duties or whose work will have deleterious effect on health over a period of time.

Risk Allowance is also paid to Sweepers and Safaiwalas engaged in cleaning of underground drains, sewer lines as well as to the employees working in trenching grounds and infectious diseases hospitals. Washing Allowance is paid to all common categories of Group ‘C’ & ‘D’ employees who have been supplied with uniform as per DoP&T letter no. 14/3/2008-JCA dated 11.09.2008 at the rate of Rs. 60/- per month, on the other hand Industrial Employees are eligible for washing allowance @ Rs. 16/- per month for washing of liveries.

Family Planning Allowance (FPA) is granted to Central Government employees as an encouragement to adhere to small family norms. The existing rates are Rs. 210/- to 500/- per month for Group ‘C’ & ‘B’ employees. You are requested to continue these allowances.

House Rent Allowance: – Sir, in present there has been a steep hike in the rent of house. Minimum rent of two rooms flat/house falls between Rs 20000/-and 40000/- in metropolitan city and it falls between 10000 and 15000 in group A cities. In such a situation reducing the rate of HRA does not justify. It should be enhanced to 15%, 25% and 35% from 8%, 16% and 24% respectively.

7. National Pension System: – Keeping social security of employees in mind Pension and Gratuity were granted after retirement which has been replaced by Contributory Pension Scheme (NPS) since January 2004. It has created a scenario of uncertainty. Even 7th CPC did not recommend anything on the matter. This federation has been demanding to scrap this NPS. Otherwise Govt of India should guarantee that none of the NPS holder would get the pension less than 50% of his last pay.

8. Fixation of Pay on Promotion: – Recommendation of one increment of 3% on Promotion cannot be justified. At least two increments should be granted on Promotion.

9. Abolishment of Interest Free Advances:- In Para 9.1.4 the 07th CPC has stated that the amount of interest free advances is quite low, hence, all the interest free advances, mentioned below, should be abolished:-
(i) Bicycle Advance,
(ii) Warm Clothing Advance,
(iii) Advance of pay on transfer,
(iv) Advance of TA on Tour/Transfer/Retirement,
(v) Advance of TA to the family of a deceased Govt employee,
(vi) Advance of leave salary,
(vii) Advance in connection with Medical treatment,
(viii) Festival Advance,
(ix) Advance of LTC,
(x) Advance in the event of Natural Calamity like, flood, cyclone,
(xi) Advance for training in Hindi and
(xii) Advance for Law Suits.

India is a country of diversities. Considering the importance of festival Government has granted the facility of Festival Advance which is recovered within a year in easy installments. But the recommendation of abolishing Festival Advance has hurt the feelings of employees very much. How 07th CPC has concluded that advance for Medical Expenses, LTC, TA on tour/transfer/death of employee is a low amount or interest free advance or advance in case of natural calamity is unjustified cannot be understood.

In this regard, entire recommendation of 07th CPC should not be given cognizance and even the amount of the some of the interest free advances like
Festival, Warm Clothing, and Natural Calamity etc. should be enhanced appropriately.

10.Overtime Allowance to the employees posted in Offices is being paid at slab rate @Rs. 12/- per hour on the recommendation of 4th CPC. It is matter of great concern that 5th CPC & 6th CPC had not enhanced the rate and now this 7th CPC recommends for 50% hike in the OTA. This is a exploitation of the duty bound Govt Employees.

11. This CPC has not reduced the period of restoration of commuted portion of pension from 15 yrs to 12 yrs.

12. 7th CPC sympathetically considered the problems of single male parent so extended the benefit at par with female employee. But on the other hand it has recommended that 1st 365 days of CCL will be paid at 100% and 2nd 365 days CCL will be paid at the rate of 80% which will cause great discontentment amongst the female employees.

13. Highly Skilled Direct Recruited – In Corps of EME, Air HQ, Naval HQ of Ministry of Defence there are sufficient number of the workers who have been recruited directly as Highly Skilled (earlier it was HS-I, prior to merger of HS-II & HS-I) and their line of promotion was Chargeman on completion of 10 years of service. But now a days, their line of promotion is too long after introduction of bifurcation system from HS to HS-I & HS-II and Master Craftsman in hierarchy for Chargeman, which is not correct and adversely affecting to their morale. It is mentionable here that the entry qualification has been enhanced to B.Sc. with Physics, Chemistry & Mathematics due to functional requirement and technical advancements. It is also mentionable that the cadre is available only in the Corps of EME. Hence it is requested that directly recruited as HS again be appoint as HS-I and their first promotion should be Chargeman as was existed earlier.

14. Technical Pay to Defence Civilians :- Since defence civilian employees (Technical) are engaged in Refitting/Repair/ Modernization/upgradation of machinery /equipments / weapons as well structural maintenance and upgradation of warships/submarines, handling, repairs, preparations, modernization / upgradations of various types of sophisticated missiles and torpedoes are also being carried out by civilian employees of Navy, Air Force & EME. Technical Allowances (Airworthiness Certificate Allowance / Flight Charge Certificate Allowance / Aeronautical Technical Allowance / Submarine Allowance, Sea/Field Trial Allowance) are given to combatants in Army, Navy, Air Force etc. and denied to Civilians deployed on similar type of Jobs.  Hence it is proposed that this allowance be given to Civilians at par with Combatants.

On the recommendations of the 06th CPC, Govt of India has sanctioned Technical Pay at the following rates for the uniform personnel:-
Airworthiness Certificate Allowance : Rs. 225 to 400/- per month
Aeronautical Allowance : Rs. 300/- per month
Flight Charge Certificate Allowance : Rs. 375 to 600/- per month
Submarine Duty Allowance : Rs. 45 to 135/- per day
Submarine Technical Allowance : Rs. 300/- month
This 07th CPC has recommended to enhance these allowances to 1.5 times. Hence, this federation demands very strongly that Technical Pay/Allowance has to be extended to the civilian employees those are involved in technical work job as described above.

15. Special Compensatory (Hill Area) Allowances: in Para 8.10.80 the 07th CPC has recommended that there is hardly any hardship involved at altitudes of 1000 meter above sea level and it should be abolished. The incumbents working in such areas like Ordnance Factory Dehradun etc. are getting this allowance at the rate between Rs. 720/- to 900/- per month. Hence, it is demanded that this allowance may be replaced by Tough Location Allowance-III as mentioned in Para. 8.10.76 (R3H3) at the rate between Rs. 1000/- to 1200/-.

16.Non-Matriculate appointed on Compassionate Grounds: Due to implementation of the recommendations of 06th CPC, vide O.M. No. 14014/2/2009-Estt(D), dated 11.02.2009 & 03.04.2012 DoP&T has issued instructions that a person who does not fulfill educational qualification of a post can be appointed as “Trainee”. A person appointed as a “Trainee” enjoys the status of Government servant from initial day and will be allowed all the allowances and benefit allowed to a government servant but he has to acquire minimum educational qualifications in 05 yrs.

07th CPC has not mentioned about such “trainee” government servant. Hence, it should be clarified about the revision of pay of existing non-matriculate trainees who have completed more than 05 yrs service and future induction of non-matriculates. Apart from above, this federation has reflected its views on the cadre related matters of OFB (copy enclosed), which may be considered with mutatis mutandis in other Directorates of MoD.

Sir, it is humble request to you to kindly consider the above in correct perspective and take appropriate directives to the authorities to redress the above anomalies/grievances arising out of recommendations of 07th CPC.

Thanking you.

Enclosed : As mentioned

Sincerely yours

(M P SINGH)

Enhanced Family Pension : No Change is being recommended by 7th CPC

Enhanced Family Pension : No Change is being recommended by 7th CPC

Increasing the existing time period of seven years for enhanced family pension

The Commission has received representations seeking enhancement in the period of enhanced family pension from the existing seven years or 67 years, whichever is less, to ten years in case of death of retirees.

Analysis and Recommendations : The current rates of enhanced family pension are–

Group X Pay for JCOs/ORs – 7th Central Pay Commission Recommendations

Group X Pay for JCOs/ORs – 7th CPC Recommendations

The 7th Pay Commission has recommended in its report regarding the Group X Pay for JCOs / ORs in Group X at Rs.6,200 per month for all X trades which involve obtaining a qualification which is equivalent of a diploma recognised by AICTE.

Group ‘X’ pay for JCOs/ORs and equivalent has been sought to be enhanced by four times from the existing rate of Rs.1,400 per month. In the context of change in nature of warfare the requirement of a higher technological threshold has been emphasised by the Services. In Defence services, there two groups ‘X’ and ‘Y’ in the three services, by way of the entry level qulaification thershold and the training imparted.

The Commission has taken due note of the emphasis being placed on skilled manpower with higher educational and technological thresholds. While determining X pay for X group of JCOs/ORs the VI CPC considered the relativity of some of the grades of JCOs/ORs in Group X with diploma holders in engineering on the civil side. In case of civilians, posts requiring minimum qualification of diploma in engineering are placed in GP 4200 and in defence forces, some of the posts in X group whose minimum qualification held equivalent to diploma in engineering are placed in GP 2800. The element of X group pay was therefore fixed at Rs.1,400.

The Commission has examined the existing educational and training requirements of X pay personnel and has already noted the wide variation that exists in the three Services in this  regard. It has therefore recommended that all X trades should mandatorily involve obtaining a qualification which is equivalent of a diploma in engineering (recognised by AICTE).

Direct Entry Diploma Holders : In Indian Coast Guard, Direct Entry Diploma Holders (DEDH) join as Yantrik in Technical Branch and are placed in GP 2400 along with a Yantrik Pay of Rs.800 per month. However, Direct Entry Diplomas Holders in other civil services, including Indian Railway are placed in GP 4200. In the Indian Navy, the Diploma Holders (Artificer-IV) with similar qualification and nature of job as of Yantrik of ICG are placed in GP 2800 along with X Pay of Rs.1,400 per month.

Indian Coast Guard: The Commission is recommending for the Indian Coast Guard: a. Merger of pay group Z into pay group Y. b. X pay of Rs.6,200 p.m. to all direct entry diploma holders.
