Subject : Disbursement of salary in cash in the Storm (Vardha) affected area of Chennai – Representation of Bharatiya Pratiraksha Mazdoor Sangh (BPMS)

Defence Civilian Employees Federation BPMS has address letter ref. no. BPMS/MoD/Payment/186(8/1R) dated 27 Dec.2016 (copy enclosed) to the MoD, on the above subject. It has been informed that the storm Vardha has caused enormous damage in the Chennai Area. The disruption of the electricity supply has adversely affected the banking services, thereby causing economic hardship to the Central Government employees working in and around the affected area. It has been requested that the serving employees in the Chennai area may please be paid the salary for the month of Dec 2016 in cash.

In view of the position reported by BPMS, it is apprehended that the ATM systems and the computer network may not be functioning in the storm affected area, which may not be allowing the public to access the electronic banking facilities. It is felt that the hardship being experienced by the affected employees should be addressed with due sensitiveness. It is suggested that necessary instructions may please be issued to the pay disbursing authorities, located in the storm affected area, to explore the possibility of disbursing the salary for the month of Dec 2016 to the Government employees in cash, in accordance with the ceilings/instructions prescribed by the Government

Grant of 3rd MACP in GP 4600 for Record Supplier, Blue Printer in Defence Establishments

Grant of 3rd MACP in GP 4600 for Record Supplier, Blue Printer in Ordnance Establishments

Dated: 22.01.2016

The Director (IR),

Subject: Grant of ACP to Record Supplier, Blue Printer etc. in OFB between 01.01.2016 to 31.08.2008.

Respected Sir,
With due regards, your attention is invited to the points raised in the JCM meetings by the Staff Side Members of this federation on the subject matter.

You have already clarified that erstwhile ACP Scheme was applicable upto 31.08.2008 and the promotions / upgradations granted prior to 01.01.2006 in the merged grade pay had been ignored for grant of ACP in the promotional hierarchy upto 31.08.2008 and this clarification had already been implemented in favour of supervisory cadre (Chargeman & JWM) of Ord Fys.

On the above analogy, Blue Printer & Record Supplier being a feeder grade for Tracer (upto 20.04.2006) which is a feeder grade for Draughtsman / Chargeman may be granted the 02 financial upgradations under the ACP Scheme by ignoring his movement upto Blue Printer & Record Supplier.

Further, your attention is invited to the order of CAT (Principal Bench) in OA No. 634/2013 (Smt Madhu Malti Tyagi & ors Versus Union of India & others) decided on  22.10.2013 wherein similar case had been dealt with and the relief was granted in favour of petitioners. Respondent No. 3 (General Manager, Ordnance Factory Muradnagar) had published the necessary Factory Order for pay fixation (copy enclosed) in this regard.

In such circumstances, you are requested to take necessary action so that similarly placed all the non-petitioner Record Supplier / Blue Printers may be granted 01st ACP in GP 2400/- and 02nd ACP in GP 4200/- on completion of 12 yrs & 24 yrs regular service between 01.01.2006 to 31.08.2008 & 03rd MACP in GP 4600/- on or after 01.09.2008 on completion of 30 yrs regular service.

Kindly resolve the issue without further delay.

Thanking you.

Sincerely yours

BPMS comments on 7th CPC recommendations related to Central Government Employees

Dated: 09.12.2015

To,
The Secretary,
Govt of India, Min of Defence,

Subject: Views/Comments of BPMS on the recommendations of 7th CPC.
Reference: Your letter No. 11(4)/2015-D(CIV-I), Dated 04.12.2015

Respected Sir,
With due regards, it is submitted that this federation has gone through the recommendations of 7th CPC and found that the recommendations are very disappointing. It appears that the 7th CPC has not considered the genuine demands of the Government employees including Civilians in Min of Defence in correct perspective. Report of 7th Central Pay Commission has led the Group ‘C’ employees in huge discontentment because 5th CPC and 6th CPC had already granted less financial benefit to the incumbents of Group ‘C’ in comparison to Group ‘A’ and Group ‘B’. Group ‘C’ employees were very much hopeful that this Pay Commission would do something better for them but non-fulfillment of their hope by 7th CPC has led Group C employees in discontentment. A few points are being put before Ministry of Defence with an expectation that it will do justice to Group ‘C’ employees.

The points are as under-

1. The ratio of minimum and maximum pay (Secretary level, not Cabinet Secretary) was 1:10.66 in 4th CPC. Further it was 1:10.19 in 5th CPC and 1:11.42 in 6th CPC. 7th CPC has extended it to 1:12.5 whereas it had been recommended in previous Pay Commissions the ratio of minimum and maximum pay should not exceed 1:8. The pay scale of officers of Secretary level has been recommended Rs 2,25,000/- and minimum pay has been recommended Rs18,000/-. You are requested to reduce this wide gap by enhancing the minimum pay to Rs 24,000/- from the proposed Rs. 18000/-

2. 6th CPC had granted more benefit to Group A and Group B officers as it had merged the Pay Scale of (5000-8000) and (5500-9000) and upgraded to Rs (6500-10500) and the pay scale of Rs. (6500-10500) and (7450-11500) had been merged, whereas none of the Pay Scales of Group C had been merged nor upgraded. It was expected to 7th CPC that it would grant some relief by merging and upgrading the Pay Scale of Group ‘C’ employees. But it did not happen. Educational qualification has been raised with respect to Pay Scale of Group C employees but Pay Scales have not been upgraded. You are requested to grant new Pay Scale of 7th CPC related to Grade Pay 2400/- by merging Grade Pay 1900 and Grade Pay 2000 and upgrading these scales to 2400/- so that Lower Division Clerks, Store Keepers, Skilled Industrial Employees, Firemen etc. may get justice. Further, new pay scale of 7th CPC related to GP 2800/- should be granted to the incumbents (like UDC, Stenographers etc.) by upgrading Grade Pay 2400/- to Grade Pay 2800/- to get justice.

3. Fitment Formula:- This CPC also applied higher Multiplying Factor of 2.72 & 2.81 for higher authorities like PB-4 whereas this has been fixed as 2.57 for PB-1 & 2.62 for PB-2. There must be uniformity in the Multiplying Factor. Further, to achieve the enhanced Minimum Pay Rs. 24000/- the Fitment formula for PB-1 & 2 should be fixed at 3.42 in place of 2.57.

4. Annual increment has been recommended 3% again, it should be enhanced to 5%. Employees are not getting their annual increment even after completing 12 months because 6th CPC has fixed July month for annual increment for all employees. They get their annual increment between 13 months and 17 months. This anomaly should be removed. The employee must be granted his annual increment just after completing 12 months from the enrollment date.

5. Modified Assured Career Progression:- 5th CPC had recommended for two financial up-gradation in the promotional hierarchy on completion service of 12 years and 24 years respectively that had been implemented by the Government from the dated: 09/08/1999. But 6th CPC had recommended for 3 financial upgradations in next Grade Pay after completing 10, 20 and 30 years of service respectively. Government granted these up-gradations in next Grade Pay in place of next Promotional Grade Pay and reduced the benefit given by the earlier government. Therefore, you are requested to issue necessary directives to implement MACP for granting next Promotional Pay Scale in place of immediate next level in the hierarchy.
Further, 5 financial upgradations under the MACP Scheme should be granted in place of 3 upgradations within service of 30 years. 07th CPC has upgraded the benchmark of Very Good in place of Good for grant of MACP which is not acceptable, hence, it should be retained Good.

6.  Allowances: – 7th CPC has recommended for abolishing 52 Allowances. To abolish Washing Allowance & Risk Allowance, Family Planning Allowance is very unfortunate. Risk Allowance covers those situations where the risk is inherent and continuous in the occupation itself with adverse effect on the health. Risk Allowance is presently given to employees engaged in hazardous duties or whose work will have deleterious effect on health over a period of time.

Risk Allowance is also paid to Sweepers and Safaiwalas engaged in cleaning of underground drains, sewer lines as well as to the employees working in trenching grounds and infectious diseases hospitals. Washing Allowance is paid to all common categories of Group ‘C’ & ‘D’ employees who have been supplied with uniform as per DoP&T letter no. 14/3/2008-JCA dated 11.09.2008 at the rate of Rs. 60/- per month, on the other hand Industrial Employees are eligible for washing allowance @ Rs. 16/- per month for washing of liveries.

Family Planning Allowance (FPA) is granted to Central Government employees as an encouragement to adhere to small family norms. The existing rates are Rs. 210/- to 500/- per month for Group ‘C’ & ‘B’ employees. You are requested to continue these allowances.

House Rent Allowance: – Sir, in present there has been a steep hike in the rent of house. Minimum rent of two rooms flat/house falls between Rs 20000/-and 40000/- in metropolitan city and it falls between 10000 and 15000 in group A cities. In such a situation reducing the rate of HRA does not justify. It should be enhanced to 15%, 25% and 35% from 8%, 16% and 24% respectively.

7. National Pension System: – Keeping social security of employees in mind Pension and Gratuity were granted after retirement which has been replaced by Contributory Pension Scheme (NPS) since January 2004. It has created a scenario of uncertainty. Even 7th CPC did not recommend anything on the matter. This federation has been demanding to scrap this NPS. Otherwise Govt of India should guarantee that none of the NPS holder would get the pension less than 50% of his last pay.

8. Fixation of Pay on Promotion: – Recommendation of one increment of 3% on Promotion cannot be justified. At least two increments should be granted on Promotion.

9. Abolishment of Interest Free Advances:- In Para 9.1.4 the 07th CPC has stated that the amount of interest free advances is quite low, hence, all the interest free advances, mentioned below, should be abolished:-
(i) Bicycle Advance,
(ii) Warm Clothing Advance,
(iii) Advance of pay on transfer,
(iv) Advance of TA on Tour/Transfer/Retirement,
(v) Advance of TA to the family of a deceased Govt employee,
(vi) Advance of leave salary,
(vii) Advance in connection with Medical treatment,
(viii) Festival Advance,
(ix) Advance of LTC,
(x) Advance in the event of Natural Calamity like, flood, cyclone,
(xi) Advance for training in Hindi and
(xii) Advance for Law Suits.

India is a country of diversities. Considering the importance of festival Government has granted the facility of Festival Advance which is recovered within a year in easy installments. But the recommendation of abolishing Festival Advance has hurt the feelings of employees very much. How 07th CPC has concluded that advance for Medical Expenses, LTC, TA on tour/transfer/death of employee is a low amount or interest free advance or advance in case of natural calamity is unjustified cannot be understood.

In this regard, entire recommendation of 07th CPC should not be given cognizance and even the amount of the some of the interest free advances like
Festival, Warm Clothing, and Natural Calamity etc. should be enhanced appropriately.

10.Overtime Allowance to the employees posted in Offices is being paid at slab rate @Rs. 12/- per hour on the recommendation of 4th CPC. It is matter of great concern that 5th CPC & 6th CPC had not enhanced the rate and now this 7th CPC recommends for 50% hike in the OTA. This is a exploitation of the duty bound Govt Employees.

11. This CPC has not reduced the period of restoration of commuted portion of pension from 15 yrs to 12 yrs.

12. 7th CPC sympathetically considered the problems of single male parent so extended the benefit at par with female employee. But on the other hand it has recommended that 1st 365 days of CCL will be paid at 100% and 2nd 365 days CCL will be paid at the rate of 80% which will cause great discontentment amongst the female employees.

13. Highly Skilled Direct Recruited – In Corps of EME, Air HQ, Naval HQ of Ministry of Defence there are sufficient number of the workers who have been recruited directly as Highly Skilled (earlier it was HS-I, prior to merger of HS-II & HS-I) and their line of promotion was Chargeman on completion of 10 years of service. But now a days, their line of promotion is too long after introduction of bifurcation system from HS to HS-I & HS-II and Master Craftsman in hierarchy for Chargeman, which is not correct and adversely affecting to their morale. It is mentionable here that the entry qualification has been enhanced to B.Sc. with Physics, Chemistry & Mathematics due to functional requirement and technical advancements. It is also mentionable that the cadre is available only in the Corps of EME. Hence it is requested that directly recruited as HS again be appoint as HS-I and their first promotion should be Chargeman as was existed earlier.

14. Technical Pay to Defence Civilians :- Since defence civilian employees (Technical) are engaged in Refitting/Repair/ Modernization/upgradation of machinery /equipments / weapons as well structural maintenance and upgradation of warships/submarines, handling, repairs, preparations, modernization / upgradations of various types of sophisticated missiles and torpedoes are also being carried out by civilian employees of Navy, Air Force & EME. Technical Allowances (Airworthiness Certificate Allowance / Flight Charge Certificate Allowance / Aeronautical Technical Allowance / Submarine Allowance, Sea/Field Trial Allowance) are given to combatants in Army, Navy, Air Force etc. and denied to Civilians deployed on similar type of Jobs.  Hence it is proposed that this allowance be given to Civilians at par with Combatants.

On the recommendations of the 06th CPC, Govt of India has sanctioned Technical Pay at the following rates for the uniform personnel:-
Airworthiness Certificate Allowance : Rs. 225 to 400/- per month
Aeronautical Allowance : Rs. 300/- per month
Flight Charge Certificate Allowance : Rs. 375 to 600/- per month
Submarine Duty Allowance : Rs. 45 to 135/- per day
Submarine Technical Allowance : Rs. 300/- month
This 07th CPC has recommended to enhance these allowances to 1.5 times. Hence, this federation demands very strongly that Technical Pay/Allowance has to be extended to the civilian employees those are involved in technical work job as described above.

15. Special Compensatory (Hill Area) Allowances: in Para 8.10.80 the 07th CPC has recommended that there is hardly any hardship involved at altitudes of 1000 meter above sea level and it should be abolished. The incumbents working in such areas like Ordnance Factory Dehradun etc. are getting this allowance at the rate between Rs. 720/- to 900/- per month. Hence, it is demanded that this allowance may be replaced by Tough Location Allowance-III as mentioned in Para. 8.10.76 (R3H3) at the rate between Rs. 1000/- to 1200/-.

16.Non-Matriculate appointed on Compassionate Grounds: Due to implementation of the recommendations of 06th CPC, vide O.M. No. 14014/2/2009-Estt(D), dated 11.02.2009 & 03.04.2012 DoP&T has issued instructions that a person who does not fulfill educational qualification of a post can be appointed as “Trainee”. A person appointed as a “Trainee” enjoys the status of Government servant from initial day and will be allowed all the allowances and benefit allowed to a government servant but he has to acquire minimum educational qualifications in 05 yrs.

07th CPC has not mentioned about such “trainee” government servant. Hence, it should be clarified about the revision of pay of existing non-matriculate trainees who have completed more than 05 yrs service and future induction of non-matriculates. Apart from above, this federation has reflected its views on the cadre related matters of OFB (copy enclosed), which may be considered with mutatis mutandis in other Directorates of MoD.

Sir, it is humble request to you to kindly consider the above in correct perspective and take appropriate directives to the authorities to redress the above anomalies/grievances arising out of recommendations of 07th CPC.

Thanking you.

Enclosed : As mentioned

Sincerely yours

(M P SINGH)

Subject: Annexure of Views / Comments of BPMS on the recommendations of 7th CPC.

Reference: This federation’s letter of even no. dated 01.12.2015

Respected Sir,
With due regards, your attention is invited to the letter cited under reference which has been sent in response to OFB letter No. 11/7th CPC/2015, Dated 27.11.2015 wherein it is mentioned that detailed justification for upgradation of Grade Pay of ‘Pharmacist’ from Rs. 2800 to Rs. 4200 for direct entry. Hence, following justification is submitted for kind consideration:-

1. It must be kept in the mind some of the factors while determining the pay scale of a particular cadre are like the source and mode of recruitment/appointment, the qualifications, the nature of work, the value judgment, responsibilities, reliability, experience, confidentiality and functional requirement etc.

2. In OFB organizational as well as other Ministries/Departments, Pharmacists are directly recruited through open competition.

3. The educational qualification of Pharmacists in OFB is Class XII in Science + two years Diploma in Pharmacy + three months training + Certificate of Registration with Pharmacy Council.

4. The educational qualification of Pharmacist is not inferior to Chargeman (Tech) or Junior Engineer whose education qualification is Class X with Science + three years Diploma in Engineering Branches. Chargeman (Tech) / Junior Engineers are recruited in the Grade Pay of Rs. 4200/-.

5. Duties of Registered Pharmacists to their Patients : Patient Counseling; Upon receipt of a prescription (prescription drug order) and following a review of the patient’s record, a Registered Pharmacist shall personally initiate discussion of matters that will enhance or optimize drug therapy with each patient or care given of such patient. Such discussion shall be in person, whenever practicable or by telephone and shall include appropriate elements of patient counseling. Such elements may include the (1) Name and description of the drugs, (2) The dosage form, dose, route of administration, and duration of drug therapy, (3) Intended use of the drug and expected action, (4) Special directions and precautions for the drug, (5) Common severe side effects or adverse effects or interactions and therapeutic contra indications that may be encountered, including their avoidance, and the action required if they occur, (6) Techniques for self monitoring drug therapy, (7) Proper storage of drugs, (8) Prescription refill information, (9) Action to be taken in the event of a missed dose, (10) To ensure rational use of drugs. The Pharmacist shall maintain the records pertaining to drugs administered to the patients (drug card) that may be utilized for the evaluation of the drug therapy. The Pharmacist is authorized (as a Health care professional) to undertake process and outcome research, health promotion and education and provide health information and also to undertake the Pharmacoepidemiological studies.

A registered pharmacist shall undertake a pharmaceutical assessment of every prescription presented for dispensing. Assessment of the prescription should include but not be limited to assessment of whether; (i) The prescription is legally valid, (ii) The prescription includes an appropriate dosage form and appropriate route of administration, (iii) Prescription is appropriate to the patient’s condition, (iv) Duration of treatment is correct, (v) Prescription is appropriate according to patient’s Para-meters (age, weight etc.) and previous medication, (vi) Prescription is compatible with other medications, (vii) Prescription is consistent with formulary and guidelines, if nay Confidence/Secrecy; Confidences concerning individual or domestic life entrusted by patients to a registered Pharmacist and defects in the disposition or character of patients observed during medical attendance shall never be revealed unless their revelation is required by the laws of State. Prognosis: The registered pharmacist shall neither exaggerate nor minimize the gravity of a patient’s condition. He shall ensure himself that the patient, his relatives or his responsible friends have such knowledge of the patient’s condition as will serve the best interest of the patient and the family. Obligations to Sick; Though a registered Pharmacist is not bound to attend each and every person asking his service, he shall not only be ever ready to respond to the calls of the sick and the injured, but shall be mindful of the high character of his mission and the responsibility he discharges in the course of his professional duties.

Public and Community Health; Pharmacist, especially those engaged in public health work, shall enlighten the public concerning quarantine regulations and measures for the prevention of epidemic and communicable diseases. At all times the registered Pharmacist shall notify the constituted public health authorities of every case of communicable disease under his care, in accordance with the laws, rules and regulations of the health authorities. When an epidemic occurs a registered s registered Pharmacist shall not abandon his duty for fear of contracting the disease himself.

6. Other Responsibilities: Pharmacist is the person, responsible for procurement of medicines as per requirement of hospital / patient from different sources of sully. He, apart from huge stick of medicines, holds charge of all medical equipments distributed in different departments of hospitals. He is responsible for proper servicing and repair of delicate and very costly equipments.

It is worth to be noted that 80% – 90% patients who are visiting Out Patient Department of the hospital do come into the contact of the Pharmacist to obtain the various services mentioned hereinabove.

From above, it is crystal clear that Pharmacists deserve for grant of higher entry grade pay of Rs. 4200/- instead of Rs. 2800/-. Hence, now the time has come to consider the above averments in correct perspective to upgrade the entry pay of Pharmacist by the Department / Ministry / Government of India because the scope of interference through judicial review is extremely limited because the Court does not normally substitute its own views for those of expert bodies like the Pay Commission unless glaring infirmities are established. Radiographers: I would like to invite your attention to the Para 7.7.49 of the recommendations of 07th CPC wherein it is mentioned that Radiographers of Defence Establishments, the entry level qualification is class XII with Science + three years Diploma in Radiography in the Grade Pay of Rs. 2800/-.

Contrary to above, Radiographers working in Ordnance Factory Organization are continuing drawing pay in the pay scale of Rs. (5000 – 8000) (Pre-revised) or Grade Pay of Rs. 4200/- as per MOD ID No. PC-II-7(3)/2001/1/D(FY-I), dated 26.10.2010 and the revision of Recruitment Rules (SRO 88, Dated 03.08.2005) to incorporate the same is under process. Hence, entry pay of Radiographers in OFB will be revised to the corresponding replacement Grade Pay of Rs. 4200/- subsequent to the implementation of 07th CPC.

Thanking you.

Sincerely yours

Respected Sir,
With due regards, it is submitted that this federation has gone through the recommendations of 7th CPC and found that the recommendations are very disappointing. It appears that the 7th CPC has not considered the genuine demands of the OFB in correct perspective. Hence, OFB is requested to examine the following matters related to the Cadres:-

1. Industrial Cadre :-
(i) BPMS has demanded that the Grade Pay of Skilled employees should be enhanced from Rs. 1900/- to Rs. 2400/-.

Skilled – 20%
Highly Skilled – 64% (HS-II 20%, HS-I 44%)
Master Craftsman – 16%

(iv) To retain the experienced employees in industrial cadre without financial hardships, it has been demanded that Master Craftsman may be promoted to MCM (Selection Grade) in the same GP of Junior Works Manager.

2. Supervisory Staff :-
(i) BPMS has demanded that the Grade Pay of Junior Works Manager should be upgraded from Rs. 4600/- to Rs. 4800/- so that after completion of 04 yrs regular service incumbents may be placed in the GP 5400/-.

(ii) Inter Grade ratio (Chargeman & JWM) should equal for Technical, Non-Technical & Store Cadre.

(i) BPMS has demanded that the Grade Pay of Store Keeper should be upgraded from Rs. 1900/- to Rs. 2400/- at par with Skilled / LDC.

(ii) BPMS has demanded that the Grade Pay of Supervisor should be upgraded from Rs. 2400/- to Rs. 2800/- at par with UDC / HS.

5. Stenographers Cadre :-
(i) BPMS has demanded that the Grade Pay of Stenographer should be upgraded from Rs. 2400/- to Rs. 2800/- at par with UDC / HS.

(ii) BPMS has demanded that the benefit of Non Functional Upgradation to 30% Steno GM!! in Secretariat in GP 4200/- on completion of 05 yrs should be extended to the Stenographers posted in the Non-Secretariat/Subordinate Offices/Establishments.

6. Fire Fighting Cadre :-
(i) Recommendations of 6th CPC on Fire Fighting Cadre have not been implemented in OFB at par with other Directorates of MOD. 07 CPC has recommended in Para 7.7.24 for drafting of Model Recruitment Rules for the Firefighting Staff of all Central Government Departments and UTs with similar designation and pay structure.

7. Motor Transport Cadre :-
(i) 07th CPC has stated in Para 7.7.16 that Ministry / Departments maycreate supervisory posts as Motor Transport Officer, Transport Supervisor, depending upon the Cadre strength and functional justification. Hence, OFB should create the post of Transport Officer & Motor Transport Officer.

8. Multi Tasking Staff (MTS) :-
(i) Contrary to the recommendations of 07th CPC mentioned in Para 7.7.37,BPMS demands that promotional quota should be enhanced from existing 5% and non-functional upgradation at promotional level should be granted to MTS.

9. Hospital Staff :-
(i) Laboratory Technicians :- As per 07th CPC recommendations, OFB/MOD should take appropriate action for aligning the Laboratory Staff in the line of cadre structure finalized by Ministry of Health & Family Welfare.
The existing incumbents not possessing the revised qualification (BSc plus DMLT) may be granted the Grade Pay of Rs. 4200/- w.e.f. 01.01.2006 if they have completed 05 yrs regular service.

(iii) Pharmacist :- 07th CPC has mentioned in Para 7.6.102 that sufficient justification does not exist to upgrade the pay levels scales of Pharmacist.

Considering the proper justification annexed with this letter, the Entry Grade Pay of Pharmacist should be upgraded to Rs. 4200/-. The Existing hierarchy of Pharmacists in Ministry of Railways / Ministry of Health & Family Welfare should also be implemented in OFB.

(iv) Medical Assistant :- Dressers of Ministry of Railways are equivalent to Medical Assistant of OFB. 07th CPC has recommended (in Para 7.6.108) that entry level qualification of Dressers is Class XII with 03 yrs experience of dressing of wounds. Hence, a higher Grade Pay of Rs. 2000/- from Rs. 1800/- would be granted to the incumbents. It further states that the existing incumbents not possessing the revised qualification may be granted the replacement pay level for the time being but on completion of 05 yrs regular service in GP 1800, they may be granted the GP of Rs. 2000/-. This should also be implemented for Medical Assistant in OFB.

(v) Mid Wife :- The entry level qualification of Mid Wife is 10+2 or equivalent with Science and 02 yrs Auxiliary Nursing Mid Wife Course and must have working knowledge of computers as per SRO 88, dated 03.08.2005. The 05th CPC has recommended the pay scale of Rs. (4000-6000) but it has not been granted to the incumbents in OFB. Hence, the existing incumbents not possessing the revised qualification may be granted the Grade Pay of Rs. 2400/- w.e.f. 01.01.2006 if they have completed 05 yrs regular service.

10. Security Staff :-
(i) The existing hierarchy of Security Staff in Department of Atomic Energy (as mentioned in Para 11.2.18 of 07th CPC) or Security Staff in DRDO under Ministry of Defence (as mentioned in Para. 11.12.129 of 07th CPC) should also be implemented in OFB.

11. Rajbhasha Cadre :-
(i) The 07th CPC has mentioned in Para 11.22.126 that the incumbents of Rajbhasha Cadre has demanded for creation of new posts, merger and upgradation of existing posts and re-designation of various posts with upgraded pay scales but the Commission is not dealing with issues relating to cadre restructuring.

(ii) However, considering the stagnation in the Official Language Cadre in OFB, number of posts of Senior Hindi Translators and Assistant Director/Official Language / Hindi Officer should be equated to provide adequate promotional prospects to them.

12. EDP Staff :-
(i) Senior Data Entry Operators may be merged with Chargeman (Tech) and this cadre may be abolished.

13. Canteen Staff :-
(i) Though 07th CPC has not upgraded the Grade Pay of this cadre, however, OFB should prepare a Cadre Review so that Canteen Employees may be promoted and stagnation may be rmoved.

Further, comments/views on the general recommendations are being offered separately for kind consideration.

Thanking you.

Sincerely yours
(M P SINGH)

RESOLUTION No. 1: Payment of Gratuity to NPS Beneficiaries

In spite of our strong opposition, the Government has made the New Pension Scheme applicable to all recruits after 01-01-2004. While continuing our opposition to the scheme, BPMS have given several inputs from time to time to ensure that maximum benefit be given to the employees.
As a part of this, the entire bye-laws and other issues pertaining to the formulation of the New Defined Contribution Pension System (popularly known as the NPS) was studies and it was found that as per clarification issued by the Ministry of Finance (Department of Economic Affairs) the NPS is a replacement for only Pension, and thus, other benefits provided to employees like Gratuity remains constant i.e. the employees enrolled under NPS are also eligible for Gratuity as per provision of extant law.

After vigorously pursuing the issue, the Department of Pension & Pensioners Welfare had issued O.M. No. 38/41/06/P&PW (A) DT. 05-05-2009, with the approval of Cabinet to provide for Invalid Pension, Family Pension, Disability Pension, Extra-Ordinary Family Pension, Retirement Gratuity and Death Gratuity in respect of NPS subscribers on provisional basis.

Consequent thereof, BPMS has been consistently demanding that this “Provisional” basis be converted into a PERMANENT BASIS feature of the NPS. The Government has, now vide DC. No. 1(4)/E-2006 DT. 17-08-2015 of JS (Pers) of the Ministry of Finance (Department of Expenditure) circulated a note proposing that the budget for the payment of gratuity be projected from the office of the Controller General of Accounts.

Subsequently, the issue has been earmarked to various Ministries, who in turn have further asked comments from various channels.

The federation having taken stock of the present situation feels that asking comments etc. is not required on a Policy decision and demands that the feature of payment of Gratuity to all NPS subscribers upon Retirement or Death, be made a Permanent feature, without further loss of time.

This resolution is therefore, unanimously adopted at the Central Executive Committee Meeting of the Federation on September 08th, 2015.

RESOLUTION No. 2: Minimum Guaranteed Benefits under NPS

In spite of our strong opposition, the Government has made the New Pension Scheme applicable to all recruits after 01-01-2004. While continuing our opposition to the scheme, BPMS have given several inputs from time to time to ensure that maximum benefit be given to the employees.

Even after a lapse of more than 10 years since the arbitrary implementation of the scheme, the Government has failed to formulate a policy ensuring “Guaranteed Minimum Pension” to the subscribers of the NPS.

Having examine the issue in detailed, BPMS now demands that without any further waste of time, the Government should frame a policy to ensure that irrespective of the financial/market conditions at the time of Retirement and/or Death of the NPS subscriber, he should get a minimum guaranteed pension equivalent to FIFTY PERCENT of his last drawn Basic Pay plus dearness relief for neutralization of price rise.

This Central Executive Committee Meeting of the Federation held at Hyderabad, on September 08th, 2015, hereby RESOLVES, to call upon the Government to frame a policy to ensure that the NPS subscribers receive a minimum guaranteed pension equivalent to FIFTY PERCENT of his last drawn Basic Pay plus dearness relief thereupon at par with Central Government Employees/Pensioners.

RESOLUTION No. 3: One time relaxation & removal of ceiling for Compassionate Appointment

The Government has imposed an arbitrary limit of 5% only for filling up of vacancies on compassionate grounds, subject to several conditions. As a result of this decision, many families are living in distress and the very concept of helping the families of those employees who die in harness, stands defeated due to imposition of this ceiling.

The Federation has been taking up the issue at all levels to relax the ceiling to enable the deserving candidate get employment and thereby provide help to the families of the deceased. Having examine the issue in detailed, BPMS now demands that without any further waste of time, the Government should frame a policy to ensure that as a onetime measure, all existing cases of compassionate appoints are provided suitable employment assistance immediately.

This Central Executive Committee Meeting of the Federation held at Hyderabad, on September 08th , 2015, hereby RESOLVES, to call upon the Government to frame a policy to ensure that one time measure, all existing cases of compassionate appoints are provided suitable employment assistance immediately and to further scrap the artificial ceiling of 5% with immediate effect.

Subject: Grant of Night Duty Allowance on the basis of Actual Salary

Reference: PC of A (Fys) Kolkata letter No. Pay/Tech-II/1206/2015/13, dated 09.09.2015

Respected Sir,

With due regards, it is submitted that the issue of payment of Night Duty Allowance based on actual salary, instead of notional pay of Rs.2200/- was resolved vide MOD ID No. 17(4)/2012/D(Civ-II), Dated 08.05.2015 in compliance of Contempt Petition (CP No. 200/2014 Shri Arvind Girija Singh & Ors versus UOI & Ors.) based on the CAT Jodhpur directions in CA No 34/2008 dated 5.11.2009 and subsequent ratifications by Hon’ble High Court and Supreme Court of India.

We are surprised to see the PC of A (Fys) letter cited under reference whereby ceiling for entitlement of Night Duty Allowance has been revised to Rs. 12380/- pay in Pay Band. We have strong objection on the issuance of this letter because PC of A (Fys) is not the competent authority to revise the ceiling of entitlement for NDA unilaterally as the original order has been issued by Ministry of Defence in consultation with Min of Finance, DoP&T, Def (Finance) and if there was any doubt regarding eligibility, PC of A (Fys) should have asked for clarification from the competent authorities through prescribed channels.

Further, all the court cases regarding revision of night duty allowance was related to the notional ceiling of Rs. 2200/- per month and this issue was resolved by ordering the NDA on the actual salary and nowhere court further fixed any real or notional ceiling. Even it has been already clarified in the earlier order which states that entitlement ceiling of Rs. 2200/- is not applicable to existing categories who are getting NDA. Prior to implementation of recommendations of 6th CPC, IEs / NIEs / NGOs upto Assistant Foreman (Technical) was entitled for Night Duty Allowance being a non-gazetted supervisory staff but now the post of Assistant Foreman is merged with JWM which is a gazetted supervisory post in OFB. Hence, all the Industrial / Non-Industrial & Non – Gazetted Supervisory staff are entitled for NDA on the basis of actual salary.

Therefore, you are requested to intervene into the matter so that all IEs/NIEs/NGOs may get the NDA as per actual salary in compliance with the court pronouncements in letter and spirit.

Thanking you.

Subject: Grant of higher Grade Pay to Fire Engine Drivers.

Respected Sir,
With due regards, your attention is invited to the structure of Fire Fighting Cadre in AOC which is notified as SRO 93 of 2006 and the hierarchy of this cadre is mentioned below:-

Subsequently, vide ID No. 2(1)/2009-D(Civ-I), dated 26.07.2010, MOD issued instructions for grant of upgraded pay scales to the Fire Fighting Staff as per 6th CPC recommendations which is mentioned below:-

Para 3 of the above MOD ID states that as for the four grade promotional scheme applicable to the civilian drivers as extended to the Fire Engine Drivers, they may continue where they exist at present and in remaining establishments, the posts of Fire Engine Drivers shall be merged with the Fire Fighting Cadre.

This upgradation and merger have disturbed the horizontal parity between Fire Fighting Cadre and Fire Engine Drivers as under:-

To remove this disparity some of the incumbents (FEDs) filed O.A. (No.060/00443/2015) in Central Administrative Tribunal – Chandigarh. On 25.05.2015 the CAT Chandigarh disposed off the O.A. with direction to respondents to take a view on the pending representations of the applicants by passing reasoned and speaking order in accordance with Law and Rules within a period of 03 months.

In such circumstances, you are requested to consider the above in correct perspective and issue necessary instructions so that the horizontal disparity between Fire Fighting Cadre and Fire Engine Drivers may be removed without further delay.

CSD Canteen facilities for Defence Civilian retired employees – Long pending demand accepted by MoD

CSD Canteen Facilities for Retired Employees – Long pending demand accepted by MoD

“CSD Canteen facilities for Defence Civilian retired employees – Long pending demand accepted by MoD”

For a number of years the Defence Civilian employees have obtained the facility to buy items at subsidized prices from CSD canteens. Especially, Ordnance Employees could buy anything from groceries to bike – at super-subsidized rates from the CSD Canteens, also called Unit Run Canteens. But these facilities were denied to retired employees.

There is no doubt that such concessions are of tremendous importance post-retirement, when the person faces extreme financial crunch. There is no denying the fact that the mental satisfaction is much higher when these items are bought at subsidized rates from these canteens. Also, denying this privilege after retirement becomes a prestige issue of sorts.

After prolonged fights by all the federations of employees union, the Centre is accepted to extend the subsidized CSD canteen facility to retired defence civilian employees too. It is being said that the Minister of Defence has given his approval to the order.(Click to view the order)

More information on this is expected soon. Issues like who qualifies for the facility, what are the items they cold buy at subsidized rates, and providing Smart Cards, etc., have not yet been decided.

One thing is for sure – retired employees can now proudly shop at the CSD canteens.

Subject: One Time Relaxation for LTC claim
Dear brothers & sisters,
Namaskar
You may be aware of that Shri S N Batwe, Patron/BPMS highlighted some of the following issues related to LTC, thereupon vide letter No. BPMS / DoP&T/ LTC / 50 (7/2/R), Dated 10.11.2014 this federation requested the DoP&T as well as MOD to consider the issues sympathetically :-

(i) Earlier { DoP&T F.No. 31011/412007-Estt.(A), dated 02.05.2008} the Group ‘B’ Central Government employees were entitled to travel by Air from their place of posting or nearest airport but now {vide DoP&T O.M. No. 31011/ 3/ 2014-Estt.(A-IV), dated 26.09.2014} only eligible Government servants may travel from their place of posting or nearest airport, hence necessary clarification was required so that the Group ‘B’ employees may be entitled to travel by Air from their place of posting or nearest airport;

(ii) Vide DoP&T F.No. 31011/4/2007-Estt (A), Dated 30.04.2012 the Air travel relaxation under LTC for NER was extended for 02 yrs from 01.05.2012, i.e., applicable upto 01.05.2014 and vide DoP&T F. No. 31011/2/2003-Estt.A-IV, dated 15.06.2012 the Air travel relaxation under LTC for J&K was extended for 02 yrs from 18.06.2012, i.e., applicable upto 18.06.2014 whereas this order grants the relaxation for air travel w.e.f. 26.09.2014. There were some of the employees who have travelled by Air under LTC in the intervening period, i.e., 01.05.2014 / 18.06.2014 and 26.09.2014 in anticipation of extension of such relaxation as per prevailing practice. To mitigate the financial hardships of such employees, the DoP&T O.M. No. 31011/ 3/ 2014-Estt.(A-IV), dated 26.09.2014 should have retrospective effect, i.e., 01.05.2014.

(iii) Some of the defence civilian employees while availing LTC by Air to destinations like A&N Islands, J&K and NER, did not follow the instructions regarding purchase of their air tickets only from the booking counters/websites of Air India or from the Authorized Travel Agents [M/s Balmer Lawrie & Co, M/s Ashok Travels & Tours and IRCTC] and their LTC claims are not being allowed. Hence, one time relaxation is required to settle these cases.

Now, Min of Defence is considering the case (iii) and invited the details from concerned authorities. Hence, all are requested to forward their details through proper channel in given format only.

Thanking you.

Subject : Proposal for seeking one time relaxation in respect of LTC 80 claims of Defence Civilian Employees

Defence Civilian Employees’ Federations are pursuing the above issue in the meetings of the JCM Departmental Council wherein they have informed that many Defence civilian employees while availing LTC by Air to destinations like A&N Islands, J&K and NER, did not follow the instructions regarding purchase of these air tickets only from the booking counters/websites of Air India or from the Authorized Travel Agents [M/s Balmer Lawrie & Co, M/s Ashok Travels & Tours and IRCTC]. A number of employees being first time travellers by air, did not observe these instructions due to ignorance. As a result, there administrative authorities have rejected their claims under LTC 80 submitted by them after performing the journey. To resolve this issue, the employees Federations have approached this Ministry and have requested to take up the matter to DoP&T with recommendation that:

a) Claims of Group C and B employees who are otherwise not entitled for Air Travel, in case they have availed LTC 80 by purchasing Air tickets from other than the authorized agents may be considered as a one time measure and a relaxation may be granted to pass their LTC claims as a special case;

b) For such employees who have purchased Air Tickets prior to 26 Sep 2014 from other than authorized agents to travel to A&N Islands, in their case, the LTC claim may be restricted to their entitled class in Steamer/Ship

2. The DoP&T have communicated vide their letter No.31011/6/2015-Estt.A IV dated 1st July addressed to JCM, National Council, that it would not be feasible to relax the LTC rules as a one-time measure. However, cases of individual hardship as recommended by Ministries/ Departments would be considered on a case to case basis.

3. Accordingly, it is proposed to take up the matter with the DoP&T for a decision on the LTC claims submitted by the defence civilian employees where the air tickets have not been purchased by these employees in accordance with the Government instructions. It is requested that the details of such cases may please be furnished in the enclosed proforma latest by 17 Aug 2015, along with views/comments, so that a consolidated proposal could be sent to the DoP&T for consideration of one time relaxation.
