One Day Strike on 15.2.2017 - Towards the inevitable end – Victory

15th FEBRUARY 2017 – ONE DAY STRIKE

Towards the inevitable end - Victory.

K.K.N. Kutty
President, Confederation of Central Govt. Employees and workers.

December-January is fog days in Northern India, especially Delhi. Because of the high level pollution, it is not fog that engulfs Delhi but smog. Temperature dips and rises quite often. Air and Rail traffics are frequently disturbed and sometimes go out of gear. It was not unknown to the National Sectt.of the Confederation when they decided to organize the rally at the Parliament street on 15th December, 2016. There was no alternative as on November, 6th, the stipulated four months period was over. The National Sectt. of the Confederation came to the conclusion that the Government of India is run by people who indulges in double speak. They have no shame even in indulging in betrayal.

Confederation has a noble history and fine tradition. It does not indulge in the nasty habit of mincing words. It exhibits the courage of calling a spade a spade. It always has stood for the interest of the employees and workers, whom it represents. It was built up over the years in the high values and traditions of a fine trade union. While it believes that despite the differences in ideology, perception, and approach to the issues and problems, methods of negotiation, unity of the employees and workers are paramount in winning demands. It was to uphold that tradition, on innumerable occasions, it agreed to defer the strike action, and ultimately even on 11th July, 2016. It had perceived correctly the weak pretensions of the Government, demonstrated before the leaders of the NJCA both on 30th june, 2016 and 6th July, 2016. Therefore, its leadership could appreciate the criticism that emanated from the right thinking persons in its stride. Many of those who chose to criticize the decision were concerned of the dent the decision to defer the strike action had created to the image of the Confederation. An explanatory campaign was the need of the hour. For sheer paucity of time, it could not be undertaken. It would have allayed the apprehensions. When it was done, though a little belatedly, it had its salutary impact. And naturally, the National Sectt. could not have indulged in the luxury of revisiting the issue with independent action programme when the climate in Delhi could become tolerable. As is the case with every vibrant organization, there are persons who take advantage of the situation, criticize and create cacophony with the intent of destroying the very organization itself. The mammoth rally at Delhi in front of the Parliament house on 15th December, 2016 was the vindication of the understanding the Confederation National Sectt. had on the issues and a magnificent reply to all those whose intent was to destroy the organization.

It is quite heartening that our Comrades, who felt betrayed by the chicanery of the Present Government, weathered the inclement weather conditions, the disruption of rail and air traffic movements, the difficulties in reaching the venue by road, the chilly atmosphere at Delhi and above all the persisting engineered criticism of certain vested interest, exhibited the anger and discontent in the most exemplary manner on 15th December, 2016. They deserve our felicitation, congratulation and grateful salute in creating yet another historic and successful programme. They have through their loud and emphatic slogans raised and followed by thousands provided the required impetus to the National Sect. and confidence to go ahead with the forward steps of the battle. The decision that was announced by the Secretary General to organize a one day token strike in protest against the attitude of the BJP Government was greeted therefore, with great enthusiasm by the rallyists

The demonetization and the consequent debilitating impact over the availability of currency has indeed made insurmountable impediments. The whole country has been taken for a ride in the name of the noble cause of cleaning the economy of the black income. Neither the generation of the black income s tapped nor its proliferation has been targeted. About one fifth of the National income of the country is stated to be in black. That hurts and hurts the common people. While the successive Governments that came to power in the country since 1991, including the present in office had been extending concessions and exemptions for the corporate giants in crores, the common people were finding it difficult to make the both ends meet. The enforcement laws fear to knock at the doors of those who have looted the Nation and refused to pay back even the loan they had contracted from the Nationalized Banks . The circus in the floor of the Parliament, session after session, precludes any serious discussion or deliberation over the good or bad of the executive decisions concerning governance. All appears to be with a design to obliterate the real issues of the people from the centre stage.

The 105,000- crores, which is a highly exaggerated financial outflow worked out by the 7th CPC for this fiscal year has been substantially reduced, thanks to the deferring the grant of enhanced allowances, disapproval of the Option No.1 granted by the commission to the Pensioners as a relief, the continuous derailing of the negotiating machinery and the sheer refusal even to abide by the decisions of the Judiciary and Arbitration Boards, deferring decision on extending the benefit of revision of wages and pension to the employees of the autonomous organizations etc. To sustain the untenable actions, threats are employed invoking the provisions of the colonial rules and regulations. A good number of participants in the magnificent rally at the Parliament street on 15th December, 2016 was the retired personnel, despite their physical debilities due to the advancing age. They look forward to the NCCPA and the Confederation to articulate, present and fight for their demands and ensure that justice is rendered to them.

There is no doubt that the ongoing struggle undertaken by the Confederation will create sanctions not only on the Government but also on those who witness it from the sidelines but refuse to become part and parcel of an event that is bound to have its imprint in the history of the movement of the Central Government employees in the country. That should not deter us but steel our determination to march to its glorious end of victory.

ONE DAY STRIKE ON 15-02-2017 : CONFEDERATION

ONE DAY STRIKE ON 15Th FEBRUARY 2017

AGAINST THE BREACH OF ASSURANCE AND BETRAYAL BY GROUP OF MINISTERS OF NDA GOVERNMENT.

TO UPHOLD THE SELF-RESPECT AND DIGNITY OF 33 LAKHS CENTRAL GOVERNMENT EMPLOYEES AND 34 LAKHS PENSIONERS.

ABOUT 15 LAKHS CENTRAL GOVERNMENT EMPLOYEES AND AUTONOMOUS BODY EMPLOYEES WILL PARTICIPATE IN THE STRIKE

• Central Government employees and Pensioners betrayed by NDA Govt. by breach of assurance given by Group of Cabinet Ministers including Shri Rajnath Singh, Shiri Arun Jaitely and Shri Suresh Prabhu regarding increase in Minimum Pay and Fitment formula. This is the worst pay revision after 2nd CPC report in 1960. Government implemented the report without any modification suggested by Staff side (JCM). In 1960 entire employees went on five days strike.

• Central Government Pensioners and Family Pensioners betrayed by NDA Government by not implementing Option-I (parity) recommended by 7th CPC and accepted by Cabinet.

• Autonomous bodies employees betrayed by NDA Government by issuing instructions NOT TO IMPLEMENT 7th CPC benefits to Autonomous body employees and Pensioners UNTIL FURTHER ORDERS.

• Three lakhs Gramin Dak Sevaks of the Postal Department betrayed by NDA Government by not extending the benefits of 7th CPC to them and also by not publishing the separate one-man committee report already submitted to the Government.
• Thousands of Casual, Part-time, contingent employees, daily rated mazdoors and contract workers are betrayed by the NDA Government by not regularizing their services and by not revising their wages on the principle of “Equal Pay for Equal Work”.

• 7th CPC Submitted its report after 21 months on 19th November 2015. Even after 13 months the NDA Government has not implemented the revised HRA, Transport Allowance and all other Allowances. Government is deliberately delaying it further to deny implementation from 01.01.2016 and also to delay it to next Financial year 2017, thereby denying arrears.

• Government betrayed Central Government employees and Pensioners by denying eligible 3% Dearness Allownace with effect from 01.07.2016. DA for pre-revised Minimum pay of 7000 is 7% = 490 per month. Same pre-revised pay of 7000 revised to 18000 after merger of 125% DA as on 01.01.2016. New DA granted for revised minimum pay of 18000 is 2% = 360 per month. Thus there is a recurring loss of Rs. 130/- per month in DA granted to Minimum pay. For other higher pay scales the loss is still higher.

• In the past, only one Committee before implementation of CPC report and one Anomaly Committed after implementation was constituted. This time Committee after Committees are constituted but no negotiated settlement with the JCM (NC) staff side on any of the issue, but only one-way hearing of the views of the staff side. Implementation Committee, Empowered Committee, Allowances Committee, Pension (Option-1) Committee, Anomaly Committee, New Pension System (NPS) Committee and Senior officers Committee (?) to discuss the issues arising out of 7th CPC recommendations. (no formal orders constituting the Group of Senior Offices Committee and no terms of reference made public). Almost six months are over after Cabinet approving pay scales and one year is over after submission of 7th CPC report, but no outcome of any committee).

• No negotiated settlement on Confederation’s 21 Point Charter of demands which includes increase in minimum pay, Fitment formula, no reduction of HRA rate, Revision of all allownaces, Restoration of abolished Advances, Option-1 for pensioners, Scrap New Pension System, Autonomous bodies wage revision, GDS Issues, Casual Labour issues, MACP promotional hierarchy and “Very good” bench mark, filling up of vacancies, removal of 5% compassionate appointment restriction, Five promotions, LDC/UDC pay upgradation, Parity in pay scales with Central Secretariat Staff, removal of CCL adverse condition, equal pay for equal work etc.

WHAT HAPPENED ON 30TH JUNE 2016 ?
AND WHO BETRAYED THE EMPLOYEES AND PENSIONERS ?

On the night of 30th June 2016, Shri Suresh Prabhu, Hon’ble Minister for Railways informed the Secretary, JCM (NC) Staff side Shri Shiv Gopal Misra that the Prime Minister had empowered three Cabinet Ministers, viz: Shri Rajnath Singh, Hon’ble Home Minister, Shri Arun Jaitely, Hon’ble Fiance Minister and Shri Suresh Prabhakar Prabhu, Hon’ble Railways Minister, to negotiate with the staff side, JCM (NC), and invited staff side (JCM) for a meeting at the Official residence of Shri Rajnath Singh, Hon’ble Home Minister on the same night 21:30 hrs. On persistent demand of the staff side (JCM), the Group of Ministers assured that the issue of increase in the Minimum wage and Fitment formula will be referred to a High Level Committee and the Committee will submit its report to the Government within four months.

NOW SIX MONTH’S ARE ALMOST OVER.
WHERE IS THE HIGH LEVEL COMMITTEE REPORT?
CHEATING……………….CHEATING………………….. CHEATING
WHEN CABINET MINISTERS BETRAY, WHAT SHALL WE DO?
STRIKE…………….STRIKE……………….. STRIKE

Strike is the only BEFITTING REPLY to those who betrayed the cause of the Central Government employees and pensioners.

We cannot go on begging before the NDA Government.

WORKERS ARE NOT BEGGARS.

Let us make the 15th February 2017 one day strike a resounding success.

Let us not surrender our prestige and self-respect before those who betrayed our cause.

NATIONAL CONVENTION ON THE DEMANDS OF GRANT OF APPROPRIATE PAY SCALES TO EMPLOYEES AND OFFICERS OF ACCOUNTS AND AUDIT

JOINT ACTION COMMITTEE OF ACCOUNTS & AUDIT EMPLOYEES & OFFICERS ORGANISATIONS
17/2 – C, P & T Quarters, Kali Bari Marg, New Delhi: – 110001

NATIONAL CONVENTION ON THE DEMANDS OF GRANT OF APPROPRIATE PAY SCALES TO EMPLOYEES AND OFFICERS OF ACCOUNTS AND AUDIT
Dated 10th January 2016

DECLARATION

The representatives of All India Audit & Accounts Association, All India Civil Accounts Employees Association, All India Postal Accounts Employees Association, All India Audit and Accounts Officers Association, All India Association of Pay & Accounts Officers (Civil), All India Civil Accounts Employees Association, Category-II, All India Federation of Divisional Accounts Officers and Divisional Accountants Associations and All India P&T Accounts & Finance Officers Association met in the National Convention on 10th January 2016, Conference Hall, 4th Floor, Nirman Bhawan, CPWD, Koti, Hyderabad.

The Convention, in conformity with the observations given by the National Joint Council of Action of the Central Government Employees, totally rejects the anti-employee recommendations of the 7th CPC. The mutilation of Dr. Aykroyd formula in computation of minimum wages based on the 12-monthly average (ending on 1.7.2015) prices of essential commodities supplied by Labour Bureau at Shimla was a total jugglery on the part of 7thCPC.

The convention considers that, reduction in the wages of women employee who avail CCL, forcing the employees to go on voluntary retirement on completion of 20 years of service in the name of ‘inefficiency’, earmarking ‘very good’ for MACP, withdrawal of all types of short term advances like festival/cycle/ LTC etc, refusal to recommend for scrapping of new Pension scheme, refusal to propose for dispensing with the outsourcing/casualisation/ contractorisation by regularizing the employees engaged through such methods for regular government functions are the most retrograde and the anti-employee recommendations of the 7CPC.

The Convention noted that on the issue of formation of Apex Level Grievance redressal mechanism to the Group B Gazetted Officers and Promotee Group A Officers, even after 67 years of independence, settlement has not taken place mainly because of intransigent and adamant stand of the Ministry of Finance, Government of India. The meeting noted that on all other demands also there is a dilly dallying attitude on the part of authorities resulting in non-settlement.

The Convention congratulates the Central Government employees for observing 27th November 2015 as BLACK DAY by wearing black badges and holding (lunch hour) demonstration at the work place and organizing lunch hour demonstration on 30th December 2015 responding to the call of NJCA, which was duly endorsed by the Confederation.
The Convention endorses the 26 Point Charter of Demands on issues related to the recommendations of the 7th CPC submitted to the Cabinet Secretary on 10th December 2015 by the Staff Side, National Council, JCM and on behalf of the NJCA and also by the CCGGOO to the Government to discuss and settle the demands immediately.

The Convention also endorses the decisions taken by NJCA on organizational actions including the decision of massive Dharna on 19th, 20th and 21st January 2016 and Indefinite Strike in the 1st Week of March 2016 with an appeal to the entirety of the Accounts and Audit Employees and Officers of the country to prepare and participate in all preparatory programmes and the Strike action under the guidance of the local Co-ordination Committees and JCAs.

The Convention takes the opportunity to congratulate all those employees and officers of Indian Audit and Accounts Department and other organised Accounts Cadre who responded the call of Apex JAC i.e. observance of demands day on 15th December 2015 and submission of the demands of the Accounts and Audit Employees and Officers in the form of Resolution to local Head of Offices for onward transmission to higher authorities.

The Convention totally agrees with the following proposals for pay structure for Audit & Accounts Cadres submitted by the apex level JAC to secretary, Department of Expenditure ON 11TH December 2015 seeking mitigation of the injustice done to the accounts and audit cadres by the 7th CPC.

1. Accounts/Audit Assistant: Re-designation of LDC as Accounts/Audit Assistants and grant of replacement scale of PB-1 Grade Pay Rs.2400 — i.e. level 4 pay scale of Table 5.Pay Matrix.

4. Assistant Accounts Officer/ Assistant Audit Officer/DAO II: Acceptance of Para No. 11.12.140 of the recommendations of 7th CPC and grant of replacement pay of GP 5400(PB-2) to AAOs on completion of four years’ service — i.e. Pay level 9, in the pay matrix.

National Council JCM and Confederation described it as Retrograde recommendations, unexpected and unacceptable

NC JCM and Confederation described it as retrograde recommendations, unexpected and unacceptable

Central Government need to pay attention to the flaws of the 7th Pay Commission report

The statistics reveals that there are 88% of total strength of Government servants are in Group ‘C’ Category.

Obviously those who are representing these 88% at the Forums which are constituted to negotiate with concerned Departments and Government about their issues are capable of weighing the advantages and disadvantages of recommendations of 7th central pay commission.

The Staff Associations and Workers federations are the one who are representing Group C and Group B at various levels of negotiating forums know the plights and facts of government servants more than anybody. They in fact never utter a word of praise on 7th CPC recommendations since the day the report was submitted to the Finance Minister.

National Council JCM and Confederation described it as Retrograde recommendations, unexpected and un acceptable. They declared that all the central government employees are upset and dis satisfied since many of their demands were not considered by 7th pay commission.

1. Pay Scales and allowances are arrived by multiplying 2.57, just 14.29 % increase over existing pay and Allowances after DA neutralization.
2. The rate of HRA has been abruptly reduced,
3. Payment of CCL has been reduced for second 365 days.
4. Same confusion in MACP continues,
5. Uncertainty in Pension benefit in NPS continues.
6. Existing Pension provisions are left un touched. None of the proposals submitted by Pensioners Associations are not considered.
7. Minimum Pay is very much less; Maximum Pay is lavishly higher. [Minimum Rs.18000 – Maximum Rs.275000]
8. Gap between Minimum and Maximum Pay is not reduced, but unfortunately increased. [In sixth CPC it is 1:12 , 7th CPC Recommends 1:14]
9. All the Pay commission reduced the number of pay scales but 7th Pay commission maintained the existing pay scales,
10. 55 Allowances are abolished, No new allowances are introduced,
11. Same 3% increment continues, NCJCM demand for Two Increment Days 1st January and 1st July is not considered
12. No considerable benefit on Promotion,
13. Interest free advances including LTC advance are abolished,
14. Except the introduction of New Pay Matrix, nothing new in the recommendations of 7th Pay commission
15. Again uniform Multiplication factor was not applied for arriving Entry Pay for various Grades.

Low value for Lower Grades high value for higher Grades. Again the disparity in arriving Entry Pay is maintained by 7th CPC also.

What sixth CPC had recommended in some cases, what Government has suggested in some issues, what the Department has told, that has been just followed by the 7th Pay commission.
So the Central government employees are expecting the Government to pay attention to the concerns of Govt servants in respect of some recommendations of 7th pay commission which need to be addressed to boost the morale of the Central Govt staffs.

The constituents of NCJCM already formed National Joint Council of Action (NJCA) to invite the attention of Central Government through agitation Programmes to settle their demands. Now they modified their charter of demands to include the issues regarding 7th Pay Commission recommendation and cautioned that unless it is not settled before March 2016, they will be going for indefinite Strike.

7th Pay Commission Report : More flaws than plus points

7th Pay Commission Report : More flaws than plus points

The much-awaited 7th Pay Commission report was submitted to the government last Thursday. The 900-page long report was perused swiftly within a day or two and criticisms have already started coming.

The very next day of submitting the report, M. Krishnan, the Confederation Secretary, gave a scathing criticism. “No other Pay Commission had submitted such a terrible report,” he said. At the very beginning of the press release, he had mentioned that the backward mindset of the recommendations of the Pay Commission have been a huge disappointment for the Central Government employees.

Contrary to all the wild speculations, a raise of only 14.29 percent was finally given to the Central Government employees. This increment is akin to two installments of the Dearness Allowance. He has strongly stated that more than 50 lakh Central Government employees and Defence Personnel have been cheated.

The 6th Pay Commission recommended 10 percent, 20 percent, and 30 percent House Rent Allowance for ten years starting from 01.01.2006. The intention behind reducing it to 24 percent, 16 percent and eight percent was not explained. Despite being very well aware of the fact that the recommendations will be in effect until 2026, the fact that the Pay Commission had tried to reduce the allocation has left the Central Government employees greatly disappointed.

MACP Promotions: Among the biggest disappointments of the 7th Pay Commission report is the fact that promotions, which are given once every ten years, so not earn any substantial benefits for the employees. They stand to gain only 3 percent hike. Another painful observation is the fact that the gap between Grade Pay 2800 and 4200 has been completely reduced.

The next big disappointment is the method of calculating the dearness allowance. This was one of the much-anticipated parts of the report. There is no clear explanation as to the reason why changes had to be made in the CPI IW BY 2001=100 method, or the 115.76 Factor.

On top of it all, the commission has introduced a new “Pay Matrix.” Our expectations of a detailed explanation about it were never fulfilled. 3 percent of the amount has been rounded off and given for each CELL.

In short, the 7th Pay Commission report is on the receiving end of lot of criticism. Central Government employees are now hoping that the Centre would intervene and do something positive for them.

Brief Note on JCM National Council Standing Committee Meeting held on 9-10-2015 at New Delhi.

Brief Note on JCM National Council Standing Committee Meeting held on 9th October 2015 at New Delhi.

Dear Comrades,

The Standing Committee of the JCM National Council met on 9th October, 2015. As you are aware, earlier, the National JCA had decided to defer the strike action and organize a massive Dharna programme at Jantar Mantar on 19th November, 2015 to register its strongest protest over the Government’s engineered delay in the submission of the 7th CPC Report. Later, the Finance Ministry has issued a statement asking the 7th CPC to factor into its report the fiscal concern of the Government, which was an unwarranted interference in the independent functioning of the Commission and to pressurise the Commission not to recommend wage rise on the basis of a sound and scientific formulation.

The Staff side on receipt of the invitation to have the meeting on 9th October, decided to respond and convey to the Government their strong resentment over the virtual dilution of the negotiating forum as also the above concerns. In the meeting the Staff side was informed that the Secretary Personnel would be meeting the Standing Committee soon and the meeting on 9thwas in fact only a prelude to understand each other’s points of views. It was in the background the meeting was held on 9th October, 2015.

The leader and Secretary, Staff Side conveyed the unanimous decision of the National JCA as under to the Government.

(a) The Standing Committee, as per procedure evolved, must be chaired by the Secretary Personnel.
(b) The JCM Machinery’s functioning should not be diluted.
(c) The promised meeting of the National Council has not taken place so far.
(d) The minutes of the last two meetings of the National Anomaly Committee have not been formally issued.
(e) ‘The Official side Secretary must convene a meeting of the Staff Side to iron out any difference in the draft minutes.’
(f) Normally meetings are held after circulation of the ATS. This has not been done.
(g) The Official Side must convey the anguish of the employees over the delay in the submission of the report by the 7th CPC which they justifyly feel has been engineered by the Government. They also pointed out that they are constrained to believe that the Govt. was unnecessarily interfering in the functioning of the Pay Commission.

We give hereunder a brief resume of the discussions held on the agenda items.

After the initial remarks made by the Staff Side all issues in the charter of demands were discussed. There had been however, no final settlement on any issue as the meeting itself was not convened for that purpose. The Staff Side stated that even the promises held out in the last meeting that the Departmental Council meeting would be held soon was not honoured.

On the question of Pay revision related issues, viz. Interim relief, DA merger, inclusion of GDS etc . elaborate discussions were held. It has come out clearly that on all these issues, the Finance Ministry has taken an nugatory Stand, even though the arguments put forth were extremely untenable. It was pointed out by the Staff Side that the Interim relief and DA merger was denied on the specious plea of submission of the report in the stipulated time. Having extended the time, the Govt. ought to have considered the grant of these two demands. There had been a very elaborate discussion on the question of inclusion of the GDS within the purview of the 7th CPC. The Postal Department’s representatives narrated the efforts made by them to the Government for conceding this demands. The Finance Ministry has stood firm and objected to the demand being agreed to. The Staff Side has, in the given situation of the 7th CPC having finalised its report, requested the Government to refer the matter to a Judicial Committee headed by the present Chairman, 7th CPC as he has now been fully apprised of the functioning of various ministries and Departments of the Government through the interaction with the Staff and official sides. No commitment was however made by the Government to the above suggestion.

On the question of induction of FDI in Railways, Corporatisation of Postal Department and Defence organisations, the representative of the Railway Ministry stated that they are constantly discussing the issues with the Railway Federations and was exploring the possibility of reaching an agreement. In the case of corporatisation of the Postal Department, it was stated that the recommendations made by the Committee was discussed with the Federations and it has been agreed that except induction of certain professionals at the managerial level to fine tune the functioning of the Department in the changed scenario, the Federations have been assured that no structural changes would be made without consulting them. However, in the case of Defence, no discussions with the Federations have been held so far.

PFRDA. The Staff Side pointed out the present scenario in the Government offices, where the number of employees and officers who are outside the ambit of the statutory pension scheme has grown and have reached in certain organisations to the extent of 25 to 30%. These employees are extremely concerned of the new scheme and their anguish have been expressed in many forms. The Unions would be compelled to take drastic action if the Government refuses to heed to their plea to effect a relook or revisit on the matter. The representatives of the Railways pointed out that the Honourable Minister for Railways was convinced of the situation and that was the reason why he had written to the Finance Ministry that in the given situation of the Railway functioning, the new scheme would not only jeopardise the interest of the Railwaymen but also of the Railway Industry itself.

On the specific question raised by the Staff side in the last meeting in respect of resolving the issues of Medical Store Deport and the Printing and Stationery department, the Staff Side stated that only the meeting of the Medical Store Depot was held and the issues have been resolved to some extent. The Printing and Stationery Department has now sent a communication to the Staff Side fixing the meeting on 15th October ‘15. The general issues emanating from the policy of outsourcing and contractorisation was also discussed at length.

JCM functioning had been the central point of discussions. The Staff Side has pointed out that unless the Government makes up its mind that the machinery should be put on operation, no industrial peace would come in the functioning of the various departments of the Govt. of India. The Staff side asked the Department of personnel to collect the information of the number of cases litigated in the courts by the Government employees in 1991 and 2015 and make a comparison to know the seriousness of the problem.

On compassionate ground appointments question, it was stated by the Staff Side that despite advancing no cogent argument by the official side for retaining the 5% ceiling, the Department of personnel does not want to make a relook into the matter. The Staff Side pointed out that large number of applications were pending in various Departments, and the concerned department would not be able to clear them even after 20 years for want of the requisite vacancies. They also pointed out that the decision of the Government to impose the 5% ceiling was amounting to a cruelty imposed on the family members of the Government servants who dies in harness.

The Labour Ministry representative was present at the meeting. The meeting did not discuss the merits and demerits of the labour reforms as the Trade Unions in the country has justifyly concluded that it has been conceived to favour the corporate houses and to take away the existing privileges of the workers. The point at issue, however, at the meeting was as to why the Labour Ministry did not cause a consultation with the Industrial Federations in the Government of India, for whom the Industrial Disputes Act is applicable. The Labour Ministry has assured to convene a meeting of the representatives of such organisations soon.

The Labour Ministry representative also stated that the government has agreed to raise the bonus ceiling but it would not be appropriate for him to make a mention of the quantum as the Cabinet is yet to give its clearance. The Government would be able to take a decision in the matter only after the Bihar elections are over.

The Staff Side explained the background of the demand for five promotions. The reaction of the official side was that the matter must be appropriately discussed only after the 7th CPC report is made available.

Historic Strike 2nd SEP 2015 – was a grand success in almost all the sectors of working class

EDITORIAL POSTAL CRUSADER OCTOBER-2015

2nd SEPTEMBER-2015 –A HISTORIC STRIKE

2nd September 2015. Historic Strike was a grand success in almost all the sectors of working class whether it is Government Sector, Public Sector, Private Sector – organized or unorganized. Crores and crores workers have taken part in it and established so many mile stones in the history of working class movement. The grand success of this strike in strategic fields like Road transport, Coal Mines, Petroleum, Power, Tele Communication is one of the important phenomenas.

This strike was organized by the sponsoring Committee of all Central Trade Unions pursuing 12 points Charter of Demands including withdrawal of anti Labour Laws amendments and FDI in strategic sectors, in protest against lend acquisition Ordinance and Bill and peasants distress and for changing the neo-liberal path of development.
The strike was the result of hard labour of the thousands of Trade Union activists who mobilized and launched vigorous campaign for the months together..

This strike of crores of workers has given clear indication to present Central Government that now the worker has awakened and he is not going to allow the attacks and dangers being unleashed on him in the pursuance of neo-liberal economic policies.

This time this strike was a grand success among Central Government Employees.

In Postal except some circles it was grand success and better than the previous strikes. It shows that the Postal Workers are also not agreed to accept the proposals and recommendations submitted by Task Force Committee headed by T.S.R. Subramanian Ex. Cabinet Secretary as Chairman who laid out a road map of corporatization and Privatization of Department of Post. This is also culmination of anger and protest of Postal Employees that the 50% Work force of this Department i.e. Gramin Dak Sevaks, who are not treated as Civil servant. The demand of NFPE and PJCA for inclusion of GDS in 7th CPC has not been accepted by Government of India. The Cadre restructuring proposals of all Cadres of Postal; were agreed long back but not being implemented. Thousands and thousands of posts in all Cadres are also not being filled besides vigorous pursuance by the NFPE and PJCA.

The PJCA comprising NFPE, FNPO, AIPU-GDS (NFPE) and NUGDS has viewed very seriously with grave concern the totally negative attitude of the Government of India and Department of Post and has decided to go on indefinite strike from 23rd Nov-2015 on the above demands.

NFPE appeals to the entirety of Postal, RMS and GDS Employees to start preparations justify now to make the indefinite strike from 23rd November-2015a grand success to compel the Government of India and Department of Post to concede our demands. Nothing in past has been achieved without struggle and nothing is going to be achieved without struggle. So unite and fight and achieve.

8.5 Lakh Central Govt Employees participated in today’s strike

8.5 Lakh Central Govt Employees participated in today’s strike – Confederation

PRESS STATEMENT

Dated: 2nd September, 2015.

PRESS STATEMENT

The initial report received at the Confederation CHQ indicates the participation of about 8.5 lakh Central Government employees in today’s general Strike action of the Indian working Class. Earlier endorsing the call of the Central trade Unions, the Confederation of CGE and workers had called upon the Central Government employees to take part in the one day strike to compel the Govt. to withdraw the anti-people and anti-worker neo-liberal policies pursued since 1991.

The report states that the offices of the Postal, Income Tax Ground Water Board, Survey of India Geological Survey of India, , Indian Bureau of Mines. Offices of the Census Departments, ISRO, Atomic Energy, Medical Store Depots, Film Institute of India, Offices of the AGMARK, various other autonomous scientific and research institutions, etc remained closed for the whole day and the work completely paralysed. The strike also paralysed the functioning of various offices of the Indian Audit and Account Department, Printing and Stationary, Census, CPWD, Civil Accounts, Indian Standards Institute etc. Total civilian employees of various Defence Organisations and Defence Accounts Departments participated in the strike. The strike in which lakhs of workers participated has cautioned the Government of the consequences of scrapping the various labour welfare legislations intended to please the Corporate houses.

The Central Government employees were particularly unhappy over the denial of the wage revision for the past 5 years, non grant of interim relief and merger of DA, the continued outsourcing and contractorisation of Governmental functions, denial of the Statutory defined benefit pension to the fresh appointees and above all the closure of the negotiating forum- JCM- since 2010. The Finance Minister’s statement in the Parliament while laying the Medium term Expenditure Framework Statement pegging the additional revenue expenses on account of salary, pension etc for the year 2016-17 at just 5% more than 2015-16 was indicative of the nugatory attitude of the Government towards its own employees’ genuine demand for wage revision. It has no doubt acted as a catalyst to the enthusiastic participation of the employees in the Strike action.

The Strike was total in Kerala, Tamilnadu. Maharashtra, Punjab ,Telengana, Andhra Pradesh, Karnataka, Jharkhand, Chattisgrah, MP, Orissa, West Bengal Assam, North Eastern States w and 80 to 90% in other States.

The Confederation secretariat congratulates the employees and their leaders, who undertook intensive Campaign to make the strike such a grand success.

The Confederation Secretariat while thanking all its members for their whole hearted participation in the Strike and making it an unprecedented success, places on record the gratitude and appreciation for the yeomen efforts of the various Central Government Pensioners organizations in supporting the strike action.

All India Strike on 2.9.2015 - Charter of Demands and Explanatory Notes

Charter of Demands and Explanatory Notes - All India Strike on 2.9.2015

Fix minimum wage with provisions of indexation – Item No.5 Charter of Demands

Fix minimum wage with provisions of indexation – Item No.5 Charter of Demands

Item No.5.
Fix minimum wage with provisions of indexation.
(i) Effect wage revision of the Central Government Employees from 01.01.2014 accepting memorandum of the staff side JCM; ensure 5-year wage revision in future; grant interim relief and merger of 100% of DA; Include Gramin Dak Sevaks within the ambit of 7th CPC. Settle all anomalies of 6th CPC.

The 7th CPC was set up in 2013 by the then Government consequent upon the continuous struggles undertaken by the Central Government under the leadership of the Confederation of Central Government employees and workers. Under its banner various struggles were carried out from December, 2010 till the announcement of the setting up of the 7th CPC. During this period, the Confederation organized one day strike on 12th December, 2012 and again two day strike action on12th and 13th February, 2014. As per the terms of reference, the Commission is to submit its report within 18 months. If they abide by the stipulated time frame, its report must be available by the end of August, 2015. In this context, the formulation made before the Commission untidily by all organizations of the Central Government, especially those participating in the National negotiating forum of JCM is worth reproducing.

All previous Pay Commissions were of the opinion that wages cannot be determined on any single principle but has to be based upon a combination of all the enunciated principles or those principles are to be factored into the process of quantification. Since the Government as an employer had not been able to grant the need based minimum wage to its own employees till date we are of the opinion that the 7th CPC must endeavour to compute the wage structure on 15th ILC norms. We suggested two other principles to be factored in to the quantification of pay beyond the minimum level. We enumerate hereunder the factors to be taken into account:

1) The Need-Based Minimum Wage concept to compute pay at the minimum level.

2) The intrinsic value of the job content of each grade and post at the intermediary level to be assessed by an expert committee. Pending finalization of such a study, the Commission may maintain the presently existing vertical and horizontal relativities.

3) To take into account the outside rates to determine the pay package at senior levels of bureaucracy but maintain the ratio between the minimum and maximum at 1 : 8 (MTS: Secretary to Govt. of India).

We make the above suggestion, being just and reasonable on the following grounds:
1. The Fair Wage Committee has held that an industry which is incapable of paying minimum wage has no justify to exist.

2. 86% of Central Government Employees are industrial or operational workers.

3. The need based minimum wage concept formulated by Dr. Aykhroyd and approved by 15 ILC was considered the most important principle in computing salary of Government employment especially of those lower level functionaries, by the 2nd, 3rd, 4th and 6th CPC.

4. It is only the fear of a heavy financial implication and the incapacity of the Indian economy at the relevant point of time, to meet the extra expenses the 2nd, 3rd and 4th CPCs were constrained to alter the formula itself with the opinion of certain nutritional experts. The legitimacy provided to Dr. Aykhroyd formula by the 15th ILC (in which the representative of Labour, Employers and Government participated) was not available for any other conceptual frame work proposed by any other “experts”. The 4th Pay Commission cited the per capita net national product increase over the years to justify lower minimum wage than what could have been as per the ILC norms. It could be seen that the earlier Pay Commissions had adopted a different principle other than the Dr. Aykhroyd formula due to financial constraints.

5. Despite elaborately detailing the concept of living wage and the amendment to the preamble of the Indian Constitution, the 4th CPC stated that the per capita net national income increase if factored would not allow them to fix the minimum wage at a higher level than Rs.750/-.

6. Even though no specific reference on the adoption of the concept of need based minimum wage was made by the Government, the 5th CPC did dwell upon it. They advocated that the 25% addition suggested by the Supreme Court to enable the worker to meet the expenses, viz., children education, medical requirements, social obligation connected with festivals, marriages, etc. must be added to arrive at the minimum wage. However, they computed the minimum wage discarding the same principle but made the percentage increase of the per capita net national product over a period of ten years as the base (or the constant relative income criterion as the most equitable norm). In order to arrive at the minimum pay, the Commission added 30.9% over the emoluments of a lowest paid employee as on 1.1.1996.

7. The 6th CPC adopted the 15th ILC norms to compute the minimum wage but made several changes to the concept Viz., the retail prices of the commodities, which goes into the reckoning was altered; the stipulated 10% for housing and 25% for social obligations, medical, children education, etc. were discarded on the plea that separate allowances had been granted. Dr. Aykhroyd had factored 7.5% as housing component in the computation of minimum wage. The question of incorporating the cost of requirement for medical, education and other social obligation was the subject matter of litigation before the Supreme Court. The Hon’ble Court directed that 25% of the minimum wage so computed must be added as a factor for the above requirement of a worker, which had not been taken into account by the ILC norms.

The contention of the 6th CPC that since children education allowance, Medical and house rent allowances are specially granted to the Central Govt. employees, the same must be taken out of the reckoning is not only wrong but also amounts to contradiction of a stand taken by the Highest judiciary of the country- Supreme Court. The 6th CPC has failed to take note of the fact that the allowances, be it HRA, Children Education allowance or Medial, granted are awfully insufficient to meet the requisite expenses. Had it not been the case, the 3rd CPC also ought to have taken the similar stand adopted by the 6th CPC. The computation appearing in page No. 60, Chapter 6 (3rd CPC report) establishes our view in the matter.

We have given in Table (.5.1..) the computation of minimum wage as per 15th ILC norms. The retail prices of the commodities/articles are the average of the retail prices ruling as on 1.1.2011 at the following cities:
1. New Delhi,2 Mumbai, 3. Chennai, 4. Kolkata, 5 Hyderabad, 6. Bhubaneswar, 7. Thiruvananthapuram, 8. Bangalore.

The minimum wage as per our computation works out to Rs.20,856/-. This must be the minimum wage for the unskilled worker as per the ILC norms. In Central Government employment presently there is no unskilled labour. The lowest level of employment is multiskilled worker/employees. The minimum educational qualification prescribed is either ITI or matriculation (10th Standard). The percentage increase of the wages of a skilled worker to that of an unskilled worker on an average had been more than 25% all throughout. We have therefore added 25% to arrive at the minimum pay for the lowest employee in Government service, which comes to Rs. 26,071/- , i.e. Rs. 26,000/- when rounded off.

Incidentally, we may mention that the minimum wages at the level of an unskilled worker as per recent wage agreement in Coal India Ltd. Is Rs.29697/-. The per-capita Net National Product increase at factor cost between – (2004-05 – 2011-12) years as per the Economic Survey for 2012-13 presented to Parliament is 57.55..%. This, if applied to the present wage at the lowest level shall work out to Rs.22857/-. For the reasons stated in the preceding paragraphs and more specifically for the reason that the Government has presently the capacity to pay as detailed in this memorandum, we request the 7th CPC to recommend the minimum pay to be assigned to the lowest level of Group C functionary in Government of India service at Rs. 26,000/-.

Another important issue, we took with the Government was the inclusion of the Grameen Dak Sewaks of the Postal Department within the ambit of the consideration of the 7th CPC. The Government did not concede our demand. The Postal Department had been objecting to this demand consistently on the plea that the Grameen Dak Sewaks were not civil servants. They had, therefore, resorted to setting up separate committees to consider the service conditions and wage rise of the Extra Departmental Agents, or Grameen Dak Sewaks. It must be stated with some satisfaction that during the negotiation that took place with the organizations of the Postal employees on the eve of the commencement of the indefinite strike action, the Postal Department had to agree to recommend the acceptance of this demand to the Government, though belatedly.

Despite the said belated suggestion made by the Postal authorities, there had been no positive response from the Government of India till date with the result the GDS, a significant segment of the Postal Department will be denied the wage revision along with the other Central Government employees, if immediate steps are not taken by the Government to ask the Commission to consider their case within a stipulated time. We give hereunder the reasons we have advanced for inclusion of GDS within the purview of the 7th CPC.

Grameen Dak Sewaks constitutes the single largest chunk of the postal workforce. Without them perhaps the rural postal system in the country will break down. The dedicated service of the Grameen Dak Sewaks keeps the postal department operational throughout the year. The system of Extra Departmental Agency was introduced by the colonial British rulers to reduce the running expenses of the postal system in the country. The exploitative system continued even after independence. By excluding the Gramin Dak Sewaks from the purview of inquiry of the Pay Commission, the Government wanted the system to continue as a means to reduce the running expenses of the Postal Department. The exclusion is sought to be made on the specious plea that the GDS are not Civil Servants.

The Government’s contention on this score had been the subject matter of judicial scrutiny. The Honourable Supreme Court has held that the Extra
Departmental Agents are holders of Civil post. The 4th Central Pay Commission also held the same view and asserted that their service conditions must be inquired into by the Pay Commission. However, when the 5th CPC is constituted, Government set up a Committee under Justice Talwar to look into their case. The Government did not implement many of the recommendations of the Talwar Committee. It is in this context we plead that the Gramin Dak Sewaks must be brought within the purview of the 7th Central Pay Commission and justice rendered to them.
