Sub: Initial pay fixation of re-employed ex-servicemen who held post below Commissioned Officer rank in Defence Forces, retired before attaining the age of 55 years and have been appointed on re-employment basis in civilian posts – Regarding.

The undersigned is directed to refer to a demand by the National Federation of Indian Railwaymen (NFIR), a recognised Federation of Railwaymen, who have requested that the initial pay of non-commissioned ex-servicemen (PBOR) who are re-employed on the Railways should be fixed by taking into account the service endered by them in the Defence Forces. They are insisting that the fixation done in the minimum of the scale of the re-employed post should be according to the procedure laid down in para 4 (b) (ii) of DOP&T’s OM s dated 31/7/86 as amended vide OM dated 11th November 2008, 5th April 2010 & 8th November, 2010. The Federation states that the content of these OMs clearly states that the Pay of re-employed former Defence Forces Personnel should be fixed as per Rule 7 of CCS (RP) Rules 2008 i.e. at the same stage of their last basic pay drawn at the time of retirement i.e. allowing one increment (in the post held at the time of retirement) for each year of service the ex-servicemen has rendered at the time of retirement with the proviso that the pay thus fixed does not exceed:-

(a) The pay drawn prior to retirement for non-commissioned officer of all three forces like Army, Navy and Air Force (Sub para 2 (ix) of Para 3 & Para 4 (b) (ii) of OM dated 31st July 1986 are relevant).

(b) Para 5 of DOP&T’s OM No. 3/13/2008-Estt.(Pay-II) dated 11th November, 2008 stipulated enhancement of existing ceiling of Rs. 26000/- for drawal of pay plus gross pension on re-employment to Rs. 80,000/- p.m.

2. However, their attention was drawn to the provisions in DOP&T’s OM No. 3/1/85-Estt.(pay-II) dated 31st July 1986 and OM NO. 3/19/2009-Estt.(Pay-II) dated 5th April 2010, governing initial pay fixation, inter alia, of re-employed ex-servicemen who held post below Commissioned Officer rank in Defence Forces and retired before attaining the age of 55 years and have been appointed on re-employment basis in the Railways. As per these orders, the initial pay of such re-employed pensioners is to be fixed in terms of provisions of Central Civil Services (Fixation of Pay of Re-employed Pensioners) Orders, 1986 issued by Department of Personnel and Training vide OM No. 3/1/85-Estt.(Pay-II) dated 31/7/1986 as amended from time to time.

3. It is to be seen that revised provision contained in Para 2 of OM dated 5th April 2010 revising the contents of Para 4(d)(i) of CCS (Fixation of Pay of Re-employed Pensioners) Orders, 1986 provides that in case of ex-servicemen who held post below Commissioned Officer rank in the Defence Forces and in the case of civilians who held posts below Group ‘A’ posts at the time of their retirement before 55 years of age, the entire pension and pension equivalent of retirement benefits shall be ignored, i.e. no duduction on this count is to be made from the initial pay fixed on re-employment. Also, in terms of the Para 4(a) and Para 4(b)(i) of CCS (Fixation of Pay of Re-employed Pensioners) Orders, 1986, as amended vide DOP&T’s OM No. 3/19/2009-Estt.(Pay.II) dated 5/4/2010, the initial pay on re-employment of such pensioners shall be fixed as per the entry pay in the revised pay structure of the re-employed post applicable in the case of Direct Recruits appointed on or after 1/1/2006 as notified vide Section II, Part A of First Schedule to CCS(Revised Pay) Rules, 2008. As is explicit, these instructions do not provide for protection of last pay drawn before retirement, in such cases. Therefore, the fixation of pay of re-employed ex-servicemen is being done accordingly on the Railways.

4. However, the Federation does not agree with the above contention and desires that the pay of ex-Defence Forces personnel re-employed in Railways should be fixed in accordance with the clarification issued vide DoP&T’s OM dated 5th April, 2010 in Para 3 (iv) & (v) which contain clarifications duly stating that the pay of the ex-servicemen, re-employed in the Central Government Organizations will be fixed in accordance with the provision contained in DoP&T’s OM No. 3/13/2008-Estt.(pay-II) dated 11/11/2008 after exercising option in the manner laid down in Rule 6 of CCS (RP) Rules, 2008 and the fixation of pay is to be regulated in accordance with the provisions of Rule 7 of CCS (RP) Rules 2008.
The Federation has further pointed out that the initial pay of a re-employed military pensioner and a direct recruit cannot be the same in view of the fact that the pay of the re-employed Defence Forces Pensioner is to be done as per the provisions of Rule 7 of CCS (RP) Rules, 2008 applicable to direct recruits – the two entrants being independent and have no co-relation with each other.

5. After protracted correspondence and discussion of the issue between NFIR and the concerned officials of this Ministry, as NFIR are still not convinced with the official stand on this issue and insisting on implementation of Para 3 (iv) and (v) of DoP&T’s O.M. Dated 5/4/2010. Hence, it was decided to refer the matter to DOP&T for clarification.

6. In the light of the position as brought out above, DOP&T are requested to clarify specifically as to whether the contention of NFIR that the pay of non-commissioned ex-servicemen (PBOR) who retire from the Defence Forces before attaining the age of 55 years, and are subsequently re-employed on the Railways should be fixed by taking into account the service rendered by them and last pay drawn in the Defence Forces, is in order, or the procedure being followed on the Railways i.e. fixing the pay of such re-employed ex-servicemen as per the entry pay in the revised pay structure of the re-employed post applicable in the case of Direct Recruits appointed on or after 1/1/2006, without any pay protection is correct.

Short Service Commissioned Officers

An Ex-Servicemen (ESM) means a person who has been released from such service after completing the specific period of engagement, otherwise than at his own request, or by way of dismissal, or discharge on account of misconduct or inefficiency and has been given a Gratuity; and includes personnel of the Territorial Army, namely, pension holders for continuous embodied service or broken spells of qualifying service.

10% of the vacancies in posts upto the level of the Assistant Commandants in all para military forces to be filled by direct recruitment in a year shall be reserved for being filled by the Ex-Servicemen.

For appointment to any vacancy in Group ‘A’ and Group ‘B’ services or posts filled by direct recruitment otherwise than on the results of an open All India Competitive Examinations, the upper age limit shall be relaxed by the length of military service increased by three years in the case of Ex-servicemen and Commissioned Officers including Emergency Commissioned Officers or Short

Service Commissioned Officers.

For appointment to any vacancy in Group ‘A’ and Group ‘B’ services or posts filled by direct recruitment on the results of an All India Competitive Examination, the Ex-servicemen and Commissioned Officers including Emergency Commissioned Officers or Short Service Commissioned Officers who have rendered at least five years military service and have been released:-

(i) On completion of assignment (including those whose assignment is due to be completed within one year) otherwise than by way of dismissal or discharge on account of misconduct or inefficiency, or

(ii) On account of physical disability attributable to military service or on invalidment shall be allowed maximum relaxation of five years in the upper age limit.

DGR Resettlement Schemes for ESM Short Service Commissioned Officers are as under:-

(i) ESM Coal Loading and Transportation Scheme.

(ii) Allotment of Bharat Petroleum Corporation Ltd. / Indian Oil Corporation Ltd. outlets Pan INDIA.

(iii) Management of CNG Station by ESM (Officers) in NCR.

(iv) DGR Sponsored Security Scheme.

(v) Coal Tipper Attachment Scheme.

(vi) Allotment of Army Surplus Vehicles.

(vii) Allotment of LPG distributorship under Government Person (GP) category scheme.

(viii) Allotment of Retail Outlet (Petrol & Diesel) under Combined Category 1 (CC1) scheme.

The Short Service Commissioned Officers are offered to undergo 24 weeks management courses in IIM, Ahmedabad, IIM, Lucknow, IIM, Indore, MDI, Gurgaon and other skill upgradation courses which are National Skills Qualifications Framework compliant.

There is no proposal for restructuring the Short Service Commission in the Ministry.

The Comptroller and Auditor General of India (CAG), in its report on implementation of Ex Servicemen Contributory Health Scheme (ECHS) during the year ending March, 2015 has made observations mainly relating to administration of the scheme by Central Organisation of Ex-Servicemen Contributory Health Scheme (CO, ECHS), functioning of the empanelled hospitals, budgetary and manpower matters, bringing out issues such as overcharging, anomalies in submission of bills and non-adherence to Memorandum of Agreement by empanelled hospitals, short supply of medicines in Polyclinics, non-disposal of expired medicines, diversion of ECHS funds for service personnel hospitals and shortage of manpower in ECHS Polyclinics etc.

Corrective steps taken / being taken to overcome the shortcomings / deficiencies include outsourcing of pharmacy, authorization of local chemists, enhancement of financial power of Officer in-charge of ECHS polyclinic to obviate the shortage of medicines, processing of medical bills of all 28 Regional Centres on-line as per rules, appropriate use of ECHS funds by the service hospitals, adherence to the terms and conditions of Memorandum of Agreement by the empanelled hospitals, recruitment of the manpower in ECHS polyclinics, de-duplication of ECHS smart cards etc.

This information was given by Minister of State for Defence Rao Inderjit Singh in a written reply to Shri MD Badaruddoza Khan and others in Lok Sabha today.

The issue regarding fixation of pay of ex-servicemen re-employed on the Railways was taken up by NFIR in the PNM. It was pointed out that the policy instructions on the issue were not been implemented on the Zonal Railways in their proper perspective and there was a lot of confusion in the matter. They had requested for issue of suitable guidelines/clarification in the matter.

2. As the Railway administration are aware, fixation of pay of ex-servicemen re-employed on the Railways is done on the basis of instructions contained in Railway Board’s letter No. PC-VI/2009/1/RSRP/2 dated 30/4/2009 read with instructions contained in letter No.E(G)86/EM 1/8 dated 21/1/87 and the clarificatory instructions issued vide letter No.E(G)2013/EM 1-4 dated 24/7/2013 and E(G)2010/EM1/2 pt. dated 12/12/2011.

3. It may be stated that Para 3 (iv) of the DOP&T’s OM dated 05.04.2010 as circulated vide Board’s letter No. E(G)2010/EM 1/2 pt. Dated 12.12.2011 is applicable in respect of persons re- employed prior to 01.01.2006 and were in re-employment as on 01.01.2006. Thus, for this category of persons, pay would have been already fixed as per V CPC provisions as on 01.01.2006. Para 3(iv) prescribes manner of pay fixation/migration to VI CPC scales, in case of PBOR persons, Commissioned Officers etc.

4. Para 3(v) of the OM dated 05.04.2010 prescribes manner of pay fixation/migration to VI CPC scales, in case of PBOR persons, Commissioned Officers etc., who retired prior to 01.01.2006 and have been re-employed after 01.01.2006 and before issue of the OM dated 05.04.2010.

5. Thus, the Paras 3(iv) and 3(v) have detailed provisions for pay fixation/fitment as per VI CPC rates, for allranks of re-employed pensioners who retired prior to 01.01.2006 and re-employed as on and after 01.01.2006 and before issue of the OM dated 05.04.2010 respectively.

6. It may also be stated that the Orders make a clear distinction between fixation of pay of those who were Commissioned Officers and those who were non-commissioned. In the case of Commissioned Officer, non-ignorable pension is deducted, but last pay drawn (with Grade Pay in the re-employment post) is allowed, in terms of para 2 of OM dated O5.04.2010.

7. In the case of non-commissioned officers, pension is not deducted and pay is allowed only at the Entry pay in the revised pay structure of the re-employed post applicable in the case of Direct Recruits appointed on or after 01.01.2006 as notified vide section II of First Schedule to RS(RP) Rules, 2008, in terms of para 2 of the OM dated 05.04.2010.

8. As regards the Federation’s demand that MSP will have to be reckoned for fixation of pay, the provision is already there vide DOP&T’s OM No. 3/19/2009-Estt. Pay-II dated 8/11/2010 which was circulated to the Railways vide Board’s letter No.E(C)2013/EM 1-4 dated 24/7/2013 which stipulates that all defence officers/personnel whose pension contains an element of MSP, that need not be deducted from the pay fixed on re-employment.

Clarification by Major Navdeep on his blog Indianmilitary.info:-

Chain mails are floating referring to a circular issued by the PCDA(P) stating that the MoD has issued orders concerning the implementation of the decision of the Supreme Court regarding grant of arrears from 01-01-2006 rather than 24-09-2012. Click here for PCDA Circular C-144 dated 14-08-2015

The news is incorrect.

The said circular only concerns defence civilian pensioners based on the letter issued for civilian pensioners by the Department of Pension and Pensioners’’ Welfare (DoPPW). It may kindly be understood that the PCDA(P) has no authority to issue circulars on its own till the time the MoD issues a Government letter to the said effect.

However, the good news is that the MoD is also working on the same and the letter should be out soon. Some added time after the issuance of the DoPPW letter was expected to be taken by the MoD since there are certain additional issues to be addressed by the MoD over and above the ones in the DoPPW letter and a mutatis-mutandis letter could not have been issued.

For example, the MoD is to add the Military Service Pay (MSP) also in addition to the elements in the civil letter and then unlike civil pensioners, separate tables would have to be ultimately prepared by the Defence Accounts Department for various ranks and different categories which are not applicable on the civil side.

Moreover, the benefit of the upward revision would be differently applied to ranks other than Commissioned Officers since they had been granted pensions based on the maximum of 5th CPC scales fitted into the 6th CPC pay bands with effect from 01-07-2009 while officers and all civil employees were granted pensions based on minimum of pay of the pay bands. The comprehensive letter alongwith comprehensive tables would definitely be issued in due course and we would have to be a little patient about the same.

Removing Anomaly in Pensions of Ex-Servicemen

Removal of anomaly, if any, in the pension being given to the various categories of ex-servicemen is a continuous process. Such anomaly is redressed, as and when it comes to the notice of the Government.

The policy of “One Rank One Pension” has been adopted by the Government to address the pension disparities. The modalities for implementation of OROP are under consideration of the Government. It will be implemented once the modalities are approved by the Government.

A Pension Grievance Cell exists in the Department of Ex-Servicemen Welfare. Grievances received by this Cell are examined and redressed in coordination with the agencies concerned in the matter. A system of holding Pension Adalat is in place to provide a credible forum for redressal of grievances of the defence pensioners. Officers concerned of every organisation involved remain present in the Adalats and the grievances are redressed on the spot. A computerized pension enquiry project “Suvigya” has been developed by the Controller General of Defence Accounts (CGDA).

It is an online pension enquiry system which would enable the ex-servicemen to know their entitlements of pension. A pensioners’ grievance cell exists in the Office of Principal Controller of defence Accounts (Pension), Allahabad.

Ever since Narendra Modi took charge as the new Prime Minister, expectations have been running high. When expectations run high, so do disappointments. Despite the fact that some time is needed for implementing the various promises that his party had made during the Parliamentary elections, questions are also being raised as to why there is such a long delay.

The Indian Ex-Servicemen Movement (IESM) has announced that it is going to launch a series of protests demanding that the One Rank One Pension scheme be implemented.

A group of Ex-Servicemen met Defence Minister Manohar Parrikar on Saturday, but he didn’t give any date by which the scheme will be implemented. Parrikar understood our problem and argument in the two meetings but he did not give us any date for OROP implementation. Therefore, we are going ahead with our agitation,” said Major-General (retd) Satbir Singh, chairperson of the Indian Ex-Servicemen Movement.

The first step is to launch a series of protests. One-Rank-One-Pension was one of the biggest and most important promises that Narendra Modi had made. According to this scheme, all the ex-servicemen of the same rank will be given the same pension irrespective of the year in which they had retired or quit the services. There shall not be any variations. Laws relating to this have to be passed by the Parliament. To probably serve as reminders to the promise made by him, large numbers of ex-servicemen used to throng all the political rallies organized by Modi.

Modi clarified that there are some legal issues that have to be sorted before the scheme is implemented, but he promised fast action. But, the ex-servicemen are going to protest from the 14th of this month to make the OROP scheme a reality. They proposed to hold a Rally at Jantar Mantar on June 14 and hunger strike from 15th onwards.

Everybody is curious to find out how Modi is going to handle this protest – probably the first large-scale show of disgruntlement against the NDA government.

“One more disappointment for the ex-servicemen who have been waiting for years for the implementation of One-Rank-One-Pension scheme”

Hundreds of thousands of ex-servicemen all over the country were eagerly waiting for any mention of the One-Rank-One-Pension scheme in Prime Minister Narendra Modi’s celebratory speech listing the accomplishments of his government in the past one year.

From the morning, websites of almost all the leading Hindi and English newspapers were constantly publishing updates. They expressed hope that the Prime Minister will mention something about the OROP scheme in his Mathura address.

In his lengthy speech, which was delivered in the evening, there was no mention of the OROP scheme.

Ex-servicemen of the Indian armed forces are divided into two classes – those who had retired or resigned before 1996, between 1996-2005, 2005-2008, and those who had quit the services after 2008 – and pensions are being granted to them accordingly. Dissatisfied ex-servicemen have been demanding for uniform pension scheme. The demand was accepted, and in 2014, the then-Congress Government announced the One-Rank-One-Pension scheme.

The then Finance Minister, P. Chidambaram announced that the Government was setting aside a sum of Rs.500 crores for this plan. When the change of rule happened, the new Government set aside a sum of Rs.1000 crores for the scheme. Yet, the scheme hasn’t been implemented to this date.

SUBJECT: Simplification of Pension process for permanently disabled children/siblings and dependent parents

Sir,
The undersigned is directed to refer to the provisions contained in the GOI, MOD letter No A/49601/AG/PS-4 (e)/3363/B/D(Pen/Ser) dated 27.08.1987 as modified vide this Ministry’s letter No.906//A/D(Pen/Ser)/05 dated 13.08.2008 and No 02(03)/2010-D(Pen/Policy) dated 17th January 2013 of the Department of Ex-Servicemen Welfare regarding grant of Pension to old parents and disabled children/sibling after the death of the pensioners/family pensioner. Certain difficulties are being experienced for grant of such pension. The matter has been examined and it has been decided to further streamline the process of grant of pension to old parents/disabled children sibling as under. The employee/pensioner/family pensioner may, at any time before or after retirement/ death of Armed Force Personnel, make a request to the Appointing Authority seeking advance approval for grant of family pension for lif to a permanently disabled child/sibling in terms of provisions contained in GOI, MOD Letter No.A/49601/AG/PS4(e)/3363/B/D (Pension/Services) dated 27.08.1987 as amended vide GOL MOD Letter No.906/ AIDGPen/Sers)/05 dated 13.08.2008, which are reproduced as under:

2. Before allowing the family pension for life to any such son or daughter, the appointing authority shall satisfy that the handicap is of such a nature so as to prevent him or her from earning his or her livelihood and the same shall be evidenced by a certificate obtained from a Medical Board comprising of a Medical Superintendent or a Principal or a Director or Head of the Institution or his nominee as Chairman and two other members, out of which at least one shall be a Specialis in the particular area of mental or physical disability including mental retardation setting out, as far as possible, the exact mental or physical condition of the child. As per GOI, MOD Letter No.PN/7995/D(Pen/Pol)/2010 dated 01.10.2010, the family Pension tothe dependent disabled siblings shall be payable if the siblings were wholly dependent upon the Armed Force Personnel immediately before his or her death and deceased Armed Force Personnel is not survived by a widow or an eligible child or eligible parents.

3(a). In terms of GOI, MOD Letter No.B/38207/AG/PS4/931/B/D(Pen/Ser) dated 6.08:-1998 the-family pension-to the parents-shall-be-payable if-the parents were wholly dependent on the Armed force Personnel immediately before his or her death and the deceased Armed force Personnel is not survived by a widow or an eligible child.

7. The authorization as indicated above shall be made in the PPO or by issuing a revised PPO if a child, parents or siblings is authorized for family pension after issue of the PPO. The revised PPO shall take the usual route to the Pension Disbursing Authority. The Pension Disbursing Authority shall start disbursing family pension to the permanently disabled child/sibling or dependent parents after the death of the pensioner/spouse/other family pensioner, as the case may be, on the basis of the PPO/revised PPO, approval of the appointing authority and the death certificates/s) of the pensioner and other family pensioners and the self-certificate for income.

8. Such an authorization shall become invalid in case a person becomes member of family after issue/amendment of such PPO and is entitled to family pension prior to the disabled child/sibling/dependent parents at the time of the death of the Pensioners/spouse. For example, the pensioner may marry/remarry after the death of first spouse or adopt a child. Such spouse/child may be eligible for family pension at the time of death of the pensioner or death/ineligibility of the spouse. A child adopted by the spouse of the pensioner shall not be treated as a member of the Family of the deceased pensioner. A decision regarding grant of family pension in such cases will be taken by the appointing authority in accordance with provisions of A151/80.

9. In order to facilitate the prompt payment of the family pension in such cases, Armed Force Personnel/pensioners/their spouses may open a bank account of such children/siblings/parents and submit the same to the Pension Sanctioning authority through the appointing authority for inclusion in the PPO /revised PPO.

10. This issues with the concurrence of the finance Division of this Ministry vide their UO No.10(01)/2015/FIN/PEN dated 24.03.2015.

‘Narendra Modi may announce one-rank one-pension later this month’

Prime Minister Narendra Modi is likely to make an announcement later this month on ex-servicemen’s long-pending demand of one-rank one-pension.

Rao Inderjit Singh, Minister of State for Defence on Tuesday told media persons that since coming to power in May last year the National Democratic Alliance consulted all stakeholders on the issue and then arrived at a decision.

“We came to power in May last year. Over the past one year we have consulted political parties, all stakeholders on one-rank one-pension, whether they are servicemen or ex-servicemen ,” he said.

Sub: Payment of Dearness Relief to re employed pensioner: Clarification thereof.
As per para l(a) of MOD letter No. 7(1)/95/D(Pen/Services) dated 28.8.2000, entire pension admissible to ex-servicemen who held post below commissioned officers (PBOR) at the time of retirement, is ignored and their pay on re-employment is to be fixed at the minimum of the pay scale of the post in which they are re-employed. Such pensioners will consequently be entitled to dearness relief on their pension.
Deptt. of Pension and Pensioners Welfare, vide their UO No.41/42/2007/P&PW(G) dt. 03.04.2008, reproduced under this office circular No. 386 dt. 19.06.2008, further clarified that if the pay is fixed at a higher stage because of advance increments and no protection of last pay drawn is given, the pay should be treated as fixed at a minimum only for the purpose of ignoring the entire pension and allowing dearness relief on pension. For availing this benefit the ex-servicemen would have retired at post below commissioned officers Rank (PBOR) before attaining the age of 55 years.
Now representations from the banks, where number of ex-clarify the elements to be taken into account for assessing the last pay drawn by the ex-servicemen for the purpose of last pay protection.
The dearness relief on re-employment should be regulated by the Pension Disbursing Agencies on the basis of certificate issued by re-employer, clearly stating whether benefit of last pay protection has been given or not. However, on examination of cases submitted by the banks it has been found that pay scale in banks are still on old pattern, whereas ex-servicemen have been retired with Pay in Pay Band, Grade Pay, MSP, Group Pay etc. In such cases it is clarified that for the purpose of assessing the last pay drawn for last pay protection, the elements to be taken into account should be last pay in pay band i.e. Band Pay plus Grade Pay, last drawn before retirement as envisaged vide MOP, PG & P, DOPT OM NO. 3/19/2009 Estt. Pay II dt. 8th Nov 2010 and no other elements should be taken for this purpose.
In view of the above, it is advised that all the cases of dearness relief where pay of ex-servicemen has been fixed at a higher stage because of advance increments may be reviewed and regulated accordingly.
