Confusion on ceiling of bonus for CG employees continues...

Confusion on ceiling of bonus for Central Government employees continues

“Doubts and debates over the ceiling of Productivity Linked Bonus to Central Government employees this year continue to plague the minds.”

The word ‘Bonus’ continues to powerfully attract the employee communities.

Given once every year, bonus or honorarium could sometimes be even bigger than the monthly salaries.

But Central Government employees are given only small amounts as bonuses each year. With the highest prescribed ceiling limit fixed at Rs.3500, the bonus is calculated based on the number of days announced.

Last year, Railway employees were given bonuses of 78 days, employees of the postal department received 60 days’ bonus. Civilian employees of the defence were given a bonus of 40 days.

Employees of the public and private sectors wrongly assume that 60 days bonus implies tow months’ salary.

In simple terms, a 30 days bonus indicates a sum of Rs.3500 approximately. 60 days bonus implies that the worker will be given Rs.7000. in case of 75 days’ bonus, the worker makes Rs.8750. The amount is equal to one-fifth the salary of the employee.

In 2007, the calculation ceiling of bonus was increased from Rs.2500 to Rs.3500pm , and the eligibility limit for bonus was raised from Rs.3500 to Rs.10,000 pm. For a number of years, all federation of Central Government employees have been demanding that the calculation ceiling limit be raised from Rs.3500. You can see its impact on all the ‘Charter of Demands‘ presented by the federations to the government.

Recently, the Government requested the trade unions to withdraw their September 2 strike notice. During the negotiations that were held between the ministers and the trade union representatives, it was reported that the Government had accepted to raise the bonus ceiling limit from Rs.3500 to Rs.7000. Sources also said that the eligibility of bonus was raised from Rs.10,000 to Rs.20,000. But, no announcements in this regard were made by the Government.

Meanwhile, Shri Vijesh Upadhyay, the General Secretary of BMS, created quite a flutter with his letter. The letter mentioned the ceiling of bonus as Rs.10,000.

The Railway workers federation, NFIR, wrote a letter to the Railway Minister on September 8. The letter demanded that the ministry take action based on the bonus announcement issued by the authorized government information bureau, PIB, on September 1, 2015.

Unless the Government clarifies its stand in the bonus issue, the social media are going to overflow with false information, and some cooked up orders too. Since the information is being eagerly awaited, Central Government employees tend to get drawn to them and some are very likely to be misguided by these rumours.

Compulsory Retirement under CCS Rules ; CG employees over 50/55 worried

Compulsory Retirement under CCS Rules ; Central Government employees over 50/55 worried

“Compulsory Retirement under CCS Rules – Following are the consequences of a law imposed by DoPT.”

The Armed Forces, Railways, Defence, and Deaprtment of Post are among the largest employers under the control of the Central Government. The largest among them, the Railways, employs more than 13 lakh employees. In all, the Central Government employees more than 34 lakh, and has more than 38 lakh pensioners on its list.

The Centre has now ordered the implementation of an old and forgotten law. According to Section 56 (J) and 56 (I) or Rule 48(1) (b) of CCS (Pension) Rules 1972, the performances of those between the ages of 50 and 55, and those who have completed 30 years of service must be reviewed by senior officers once every three months, vis. Jan to Mar, Apr to Jun, Jul to Sep and Oct to Dec. All the departments have been ordered to review the performances and implement this rule immediately. And also advised to constitute a Review Committee consisting of two Members at appropriate level.

Relevant orders to this effect were issued on September 11. Senior officials and employees of various departments are confused and terrified following the orders.

Some claim that the government has taken this step to stifle the indefinite strike to be held in November. The Central Government employees union and the railway employees’ union claim that, armed with this rule, the government can send home workers under the compulsory retirement scheme.

The order quoted, “If conduct of a government employee becomes unbecoming to the public interest or obstructs the efficiency in public services, the government has an absolute justify to compulsorily retire such an employee in public interest.”

Govt mulls to execute compulsory retirement to CG employee for better administration

Govt mulls to execute compulsory retirement to Central Government employee for better administration

Compulsory Retirement to Central Government Employees on the Basis of their Efficiency may be a Difficult Task for the Government….

Recently, the Central Government had issued an order (No.25013/01/2013-Estt.A-IV) regarding strengthening of administration by executing compulsory retirement to the central government employees who are found to be inefficient, incapable or unable to fulfill the targets set by their higher authorities, after completing certain years of service.

The order brought panic among employees and questions arise how to identify those employees who are given compulsory retirement. The order was issued on the basis of CCS (Pension) Rule 56 (j) and Rule 48 which explains the above points. The government had clarified that if the order comes into effect, it won’t be treated as a punishment to the employees.

Article 311 of the Constitution of India says that the government should ensure security to an employee. As per the Rule, an employee should be well informed of any actions to be taken against him and be to given opportunity to explain on his part. But this rule is not applicable to criminal offences or against the security of the country.

The order which was released by DOPT, with some Supreme Court orders was a little bit strong than the previous ones. But it will not be an easy exercise for the government to implement the order as it has to face strong opposition from the employees, Trade Unions and Federations.

To analyze and determine employees’ efficiency was always a headache for the government. In the 6th CPC, the commission recommended special yearly increment to 20% of the central government employees in each department for outstanding performance on their field. But no such appreciations had happened so far in any of the departments.

Let us wait and see what will happen next….!

7th Pay Commission proposes to increase HRA of Central Government Employees

7th Pay Commission proposes to increase House Rent Allowance of Central Government employees

Seventh Pay Commission To Propose Higher HRA

New Delhi: The Seventh Pay Commission is likely to propose to increase House Rent Allowance (HRA) of central government employees, besides their basic salaries.

By giving House Rent Allowance hikes, the Pay Commission is likely to seek to encourage property owners to rent out their properties, reduce the shortage of dwellings and to provide ‘housing for all central government employees’.

Besides the basic salary, a large portion of central government employees’ salary is the House Rent Allowance; some changes will be made in that category this time.

Instead of the existing three areas for house rent, four are likely to be created. ‘X’ class cities Ahmedabad, Bangalore, Chennai, Delhi, Hyderabad, Kolkata, Mumbai and Pune, where employees will get 40 percent of their basic salary as House Rent Allowance (HRA), increasing from the existing 30 percent.

Employees posted at ‘Y’ class cities covers near about 90 stations, will receive 30 percent of basic salary, instead of the existing 20 percent.

A new area will be opened for the district towns; the central government employees will get 20 percent of their basic salary as House Rent Allowance (HRA) there.

In other areas, the house rent allowance will be 10 percent of basic, which is the existing rate of House Rent Allowance (HRA) of ‘Z’ class cities.

The existing qualifying threshold of population for HRA classification is 50 lakh and above for X, 5-50 lakh for Y and below 5 lakh for Z class cities.

However, the central government’s salary bill will rise by 9.56% to Rs 1,00,619 crore with the implementation of the recommendations of the Seventh Pay Commission, according to a statement tabled in Parliament by Union Finance Minister Arun Jaitley on August 12.

CG Employees demand of date of effect from Jan 2014 is fully justified.

Central Government Employees demand of date of effect from Jan 2014 is fully justified.

Comrades,
Now the Government has announced the One Rank One Pension Scheme for Defence veterans. Its Highlights are as follows.

The benefit will be given with effect from 1st July, 2014. Arrears will be paid in four half-yearly instalments. All widows, including war widows, will be paid arrears in one instalment.
To begin with, OROP would be fixed on the basis of calendar year 2013. Pension will be re-fixed for all pensioners retiring in the same rank and with the same length of service as the average of minimum and maximum pension in 2013. Those drawing pensions above the average will be protected.

In future, the pension would be re-fixed every 5 years.

Now we should expect the 7th CPC report to be submitted in next three months( after Bihar Elections)

Now the Defence veterans are now having five years wage revision. The government has allowed Central Public Sector units to revise wages of all non-executive employees every five years instead of 10 years. Bank employees are having five years wage revision.

Why not Central Government employees have the same five years wage revision provided to others and have a permanent wage review body. Now our demand of Central Government employees by the staff side JCM for date of effect from Jan 2014 is fully justified by Government issuing orders for others for five years wage revision as in case of Defence veterans, Bank employees and Central Public Sector.

Comradely yours

Children of Government servants should study only in Government schools – Allahabad High Court

Children of Government servants should study only in Government schools – Allahabad High Court

The Allahabad High Court has issued strict orders that the children of government employees should study only at government schools.

A Public Interest Litigation was filed at the Allahabad High Court stating that in Uttar Pradesh, led by its Samajwadi party Chief Minister Akhilesh Yadav, the government-run schools do not have sufficient teachers. The officials were not taking any steps to improve the standard of education in these schools and infrastructure was poor.

After hearing the arguments, Justice Sudhir Agarwal issued an order, excerpts of which are provided below:

All the government employees shall enroll their children only at government-run schools. The rule is applicable also to the representatives of the people, and the employees of the justice department. The state government can impose penalties to stop them from admitting their children to private schools.

The employees can be made to pay as penalty the sum that they had paid as fees to the private schools. The revenue thus generated can be added to the state exchequer. The Chief Secretary of the state was given six months to submit a report on this reform.

Revision of classification cities for the purpose of grant of House Rent Allowance and Transport Allowance to Central Government employees

Revision of the classification/upgradation certain cities/towns on the basis of Census-2011 for the purpose of grant of House Rent Allowance and Transport Allowance to Central Government employees

The Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, has given its approval to the proposal of the Ministry of Finance, Department of Expenditure for reclassification/upgradation of certain cities/towns on the basis of Census-2011, for the purpose of grant of House Rent Allowance (HRA) and Transport Allowance to Central Government employees.

Six cities have qualified for being upgraded from “Other Places” to specified higher class for the purpose of Transport Allowance.

The revised classification of cities shall take effect from 01.04.2014. The impact on the exchequer on account of upgradation of 29 cities, would be approx. Rs.128 crore for the year 2014-15.

The existing qualifying limits of population for classification for HRA purpose is 50 lakhs & above for ‘X’, 5 – 50 lakhs for ‘Y’ and below 5 lakhs for ‘Z’ class city. Transport allowance is payable at ‘higher rates’ in 13 specified cities classified earlier as ‘A-1′ / ‘A’ (that is those cities having population of 20 lakhs & above) and at ‘lower rates’ in all other places.

The classification of cities/towns for this purpose is revised on the basis of their population as reflected in the decennial census report. The existing classification of various cities/towns is based on 2001 Census figures. The criterion of population for this purpose has been followed as recommended by the Central Pay Commissions.

Dear Cooleagues,
The National Council (JCM) constituents had their convention at New Delhi on 11.12.2014 and issued a joint declaration on Charter of Demands of Central Government employees and also declared their proposed action programme which you all are aware.

A letter has been sent to Cabinet Secretary alongwith Joint Declaration and Charter of Demands.

After reveiving the joint declaration and Charter of Demands, the Secretary, DoP&T called for a meeting to below for the information of all the unions affiliated to INDWF.

1. It was very much emphasised that the forum of JCM councils should be made effective. All the Departmental councils and National Council JCM should be conducted regularly so that the issues of Government employees can be discussed. It was agreed to take necessary steps to conduct the meetings regularly.

2. All agreed anomalies should be implemented particularly the fixation of pay between direct recruitees and promotees.

3. Anomaly committee should be convened to settle the pending issues.

4. MACP issues wherever courts have given judgements that should be considered and orders should be given to implement the same before 7th CPC report.

5. Wherever the Departments have recommended for improvement in Grade Pay of certain categories of employees should be considered by DOP&T and Ministry of Finance.

Further on Charter of Demands were discussed :
6. Pay Revision should be given effect from January 2014 due to the DA increase. Also in future, pay should be reivsed on completion of every 5 years.

7. Merger of DA upto 100%. It was insisted to direct the 7th CPC to consider and given their report by Ministry of Finance. After receiving a request from Staff Side it was agreed to consider.

8. Similarly on Interim Relief, after receiving a request letter from Staff Side, this will be processed.

9. Merger of Unskilled and Semi Skilled to Rs.1800/- Grade Pay, DoP&T has rejected to grant w.e.f.1.9.2008 which is against the CDS(RP) Rules 2008. It will be reconsidered after receiving a note from Defence Ministry.

10. MACP should be granted w.e.f.1.1.2006 for the benefit of reitired employees.

11. Wherever the promotion posts and feeder posts are identical (MAC and Chargeman) that should not be treated as promotion on their movement and ACP/MACP to be granted.

12. Railways and Defence employees should be exempted from NEW PENSION SCHEME.

13. On compassionate ground appointments ceiling of 5% to be removed which is without any rational.

The above points will be considered for remaining points, another meeting will be held with progress.

Yours Sincerely,
sd/-

General Secretary
