Subject: Travel entitlements of Government employees for the purpose of LTC post Seventh Central Pay Commission – clarification reg.

The undersigned is directed to refer to this Department’s O.M.of even no. dated 19.09.2017 on the subject noted above, which inter-alia provides that the travel entitlements of Government servants for the purpose of LTC shall be the same as TA entitlements as notified vide Ministry of Finance’s O.M. dated 13.07.2017, except the air travel entitlement for Level 6 to Level 8 of the Pay Matrix, which is allowed in respect of TA only and not for LTC.

2. In this regard, this Department is in receipt of references from Government employees and various Departments seeking clarification as to whether travel by Business class for the purpose of LTC, shall be allowed to the Government employees as per their TA entitlements, or the earlier instructions regarding air travel by Economy class only as provided in Department of Expenditure’s O.M. No. 19024/1/2009-E.IV dated 16.09.2010 shall continue to exist.

3. The matter has been examined in consultation with Department of Expenditure and it is hereby clarified that in line with DoPT’s instructions dated 19.09.2017, the Government employees in the bracket of pay level 14 and above, shall be entitled for air travel in Business/Club class for the purpose of LTC. However, other conditions like rate ceiling of LTC-80 fare and booking of tickets through authorised modes, shall continue to exist.

Subject:- Central Civil Services (Conduct) Rules 1961 – Guidelines regarding prevention of sexual harassment of women at the workplace – regarding.

The undersigned is directed to refer to the DoPT OM number No.11013/2/2014-Estt.A-III, dated the 16th July, 2015 etc., vide which need for effective mechanism to ensure that inquiries in the case of allegations of sexual harassment are conducted as per the prescribed procedure and that they are monitored have been issued. Recently, a meeting was held under the Chairmanship of Minister, Women and Child Development wherein concern was expressed that the inquiries in such cases are taking unduly long time. It has, therefore, been decided that the following further steps may be taken to ensure that the inquiries are conducted expeditiously and the aggrieved women are not subjected to victimization:

(1) As already conveyed vide OM dated 2nd February, 2015 all Ministries/Departments shall include in their Annual Reports information related to the number of such cases and their disposal.

(2) As far as practicable, the inquiry in such cases should be completed within 1 month and in no case should it take more than 90 days as per the limit prescribed under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

(3) It should be ensured that the aggrieved women are not victimized in connection with the complaints filed by them. For a period of five years after a decision in a proven case of sexual harassment, a watch should be kept to ensure that she is not subjected to vendetta. She should not be posted under the Respondent, or any other person where there may be a reasonable ground to believe that she may be subjected to harassment on this account. In case of any victimization the complainant may submit a representation to the Secretary in the case of Ministries/Departments and Head of the Organization in other cases. These representations should be dealt with sensitivity, in consultation with the Complaints Committee, Ministries/Departments and Head of the Organization in other cases. These representations should be dealt with sensitivity, in consultation with the Complaints Committee, and a decision taken within 15 days of the submission of the same.

(4) All Ministries/Departments shall furnish a monthly report to the Ministry of Women and Child Development giving details of number of complaints received, disposed of and action taken in the case.

The undersigned is directed to refer to tis Departments D.O. letter No.3/8/2015-CS.I(D) dated 26.02.2016 and subsequent reminders dated and 29.11.2016 which the cadre units CSSS were requested to furnish the inputs in the format annexed therewith with respect to the who in the opinion of Mitstry/Department, are coveted under extant provisions of FR 56 (j)/Rule 48 of CCS(Pension) Rule, 1972. However, the inputs sought in respect of PA Grade are still awaited from several Ministries/Departments.

2. It is, therefore. once again requested to all the defaulting cadre units to furnish the requisite information in respect of PA Grade who are due to review under the provisions of FR 56(j) to this Department within a week positively.

Subject: Submission of Immovable Property Return for the year 2016 (as on 31.12.2016) by the Officers of the Central Secretariat Services -regarding

In terms of Rule 18 of the GCS (Conduct) Rules, 1964, the Immovable Property Return (IPR) for the year 2016 (as on 31.12.2016) is required to be furnished by the CSS Officers latest by 31.01.2017. Non-submission of the IPR within the stipulated time period/date leads to the denial of vigilance clearance to the CSS officers for empanelment, deputation, cadre clearance etc.

2. It is observed that some Officers either do not file their on-line IPR in time or file the same after the stipulated time period/date, when they apply for deputation etc., This leads to administrative difficulties while processing their case(s), as filing of IPR within the stipulated time / period is mandatory.

3. It is, therefore, requested that the CSS officers may be directed to file their Immovable Property Return (IPR) for the year 2016 (as on 31.12.2016) in time by 31.01.2017 through the Web Based Cadre Management System only. IPRs received beyond the stipulated date or vide off-line mode shall not be regarded as conforming to the extant guidelines.

Subject: Court orders against Government of India instructions on service matters — consultation with Ministry of Law and Department of Personnel and Training on question of filing appeals.

The undersigned is directed to refer to this Department's O.M. of even number dated 16.03.2016 (copy enclosed) on the above mentioned subject and to say that the Department of Personnel and Training is the nodal Department that formulates policies on service matters and issues instructions in this regard from time to time. Vide para 4 of the O.M. dated 16.03.2016, it was explained how action on different decisions/orders of the Courts/CAT has to be taken after consulting Department of Legal Affairs and DOP&T.

2. In this regard, it is pertinent to point out here that the Parliament committee on the Welfare of SCs and STs in its report has observed that the above instructions are not being followed stringently by the Ministries/ Departments. The Ministries/Departments are independently fighting out service related cases to the detriment of employees particularly those belonging to the reserved categories. The Committee, therefore, desired that this Department reiterate the standing instructions.

3. In view of the above, all the Ministries/ Departments are once again requested to scrupulously follow the instructions contained in this Department's OM dated 16.03.2016 while taking action on the decisions/orders of the Courts / CAT.

No need for filing of Declarations of assets and liabilities by Public servants

Now there is no requirement for filing of Declarations of assets and liabilities by Public servants. Because the Government is in the process of finalising a fresh set of Rules. The said rules will be notified in due course to prescribe the form, manner and timeliness for filing of assets and liabilities. All Public Servants will henceforth be required to file the declarations as may be prescribed by the fresh set of rules

Latest Guidelines for nomination in SCOVA

The Standing Committee of Voluntary Agencies (SCOVA) is a forum for holding consultation with the stakeholders, i.e., the pensioners through their Associations and various Ministries/Departments of the Government of India to get feedback on implementation of pension related policies, to discuss and critically examine the policy initiatives and to mobilise voluntary efforts to supplement the Government action.

A mechanism has been put in place for nomination of a Standing Group comprising of 5 Associations and a Rotating Group comprising of 10 Associations through a Resolution issued from time to time. As per the existing mechanism the Standing Group serves for 3 terms of 2 years each or till the pleasure of the Chairman of SCOVA whichever is earlier and Rotating Group serves for 1 term of 2 years and is eligible for re-nomination for one more term. These Associations represent various categories of Central Government pensioners from various Regions/States.

This was stated by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Shri Mahendra Singh Mahra in the Rajya Sabha today.

Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 — Fulfillment procedural requirements.

The undersigned is directed to refer to para 8 and 9 of the Guidelines enclosed in this Department’s O.M. of even number dated 18.2.2016 on the above noted subject and to say that the issues have been revisited in consultation with the Department of Expenditure. It has been decided that the cases where a Government servant travels on LTC upto the nearest airport/railway station/ bus terminal by authorised mode of transport and undertakes rest of the journey to the declared place of visit by private transport/own arrangement, may be dealt with as follows:-

(i) When public transport is available between the nearest airport/railway station/ bus terminal and the declared place of visit:-

The Government servant may also be reimbursed the fare incurred for completion of journey to the declared place of visit by own arrangement. This will be restricted to the fare admissible for journey by otherwise entitled mode of public transport from the nearest airport/railway station/ bus terminal to the declared place of visit. The Government servant shall be required to submit an undertaking that he has actually visited the declared place of visit.

(ii) Where no public transport is available between the nearest airport/railway station/bus terminal and the declared place of visit:-

(a) In case he does not wish to claim reimbursement for the part of the journey which he has undertaken by his own arrangement, he may be reimbursed for the part of the journey which he has undertaken by public transport. The Government servant shall be required to submit an undertaking that he has actually visited the declared place of visit.

(b) Where the Government servant claims assistance for the entire journey, the part of the journey where he has used his own arrangement would also be reimbursed as per his entitlement for journey on transfer. The Government servant shall be required to submit an undertaking that he has actually visited the declared place of visit.

2. In case of (b) above, the Government servant shall be required to submit a certificate that the mode of transport used by him operates from point to point on regular basis with the approval of the State Government/Transport authorities, and is authorised to ply as public carrier.

3. Above certificate need not be insisted upon in case information to the effect that (i) no public transport is available in a particular area, (ii) list of transport operators who operate on regular basis from point to point on regular basis with the specific approval of the State Government/Transport authorities, is available on the website of a State/Central Government or a State or Central PSU or in a current publication brought out by these authorities.

Subject: Court orders against Government of India instructions on service matters-consultation with Ministry of Law and Department of Personnel and Training on question of filing appeals.

The undersigned is directed to refer to this Department’s O.M.No.28027/9/99- Estt.(A) dated 1st May, 2000 on the above subject ( copy enclosed) and to say that the Department of Personnel and Training is the nodal Department that formulates policies on service matters and issues instructions from time to time. These instructions are to be followed by the Ministries/ Departments of the Central Government scrupulously. All the Court cases filed by employees have to be defended on the basis of the facts available with the Administrative Ministry/Department concerned, keeping in view the instructions issued on the subject by this Department.

2. Reference is also invited to the Cabinet Secretariat’s D.0 letter No. 6/1/1/94-Cab dated 25.02.1994 and the Department of Expenditure’s O.M. No. 7(8)/2012-E-II(A) dated 16.05.2012 inter-alia provide that (i) a common counter reply should be filed before a Court of Law on behalf of the Union of India by the concerned administrative Department/ Ministry where the petitioner is serving or has last served; and (ii) a unified stand should be adopted instead of bringing out each Department’s/Ministry’s point of view in the said reply. It further provides that it is primarily the responsibility of the Administrative Ministry to ensure that timely action is taken at each stage a Court case goes through and that a unified stand is adopted on behalf of Government of India at every such stage. In no case should the litigation be allowed to prolong to the extent that it results in contempt proceedings.

3. However, it is noticed that the Ministries/Departments are making several references to this Department seeking interpretation of the guidelines without exercising due diligence. The Ministries/Departments are advised not to make any references to this Department unless there are difficulties relating to interpretation/application of these guidelines or any relaxation in Rules/instructions is warranted to mitigate a genuine hardship faced the Government servant. While seeking advice of this Department, instructions contained in this Department’s O.M. number 43011/9/2014-Estt (D) dated 28.10.2015 may be followed.

2. HoO and HoD of the Ministries/Departments concerned are requested to kindly scrutinize the pending write-ups for acceptance/publication at the earliest.

3. All Ministries/Department are also requested to impress upon CSS/CSSS officers retiring within a period of six months to submit a write-up providing details of their work that has contributed to the efficiency, economy and effectiveness of Government functioning or/and any innovation which led to improved work culture or any other contribution considered significant. The undersigned is directed to refer to this Departrnent’s Office Memorandums of even number dated 21.12.2015 and 18.01.2016 on the subject cited above (available at persmin.nic.in -> DOPT -> Central Secretairat -> CSS -> Property Return).

2. A large number of CSS Officers have not yet submitted the Immovable  Properly Retun for the year 2015 on 31.12.2015). As already informed,  IPR should be submitted by all CSS officers through the Web Based Cadre Management System which is hosted at cscms.nic.in. However, as large number of officers are accessing the system, it has become slow making it diflicult to submit the return online. As the system is web based, officers may try filing IPR beyond office hours when the system is less congested. If it is still not possible to file the return online for any reason, they should file the return in paper format to their offices by the stipulated date i.e. 31.01.2016. They may subsequently file the same through cscms.nic.in.

No.AB.14017/48/2010-Estt.(RR) dated 31 stDecember, 2010 on framing/amendment/relaxation of Recruitment Rules wherein it has been stipulated that the Recruitment Rules or amendment(s) thereto as finally approved by the Union Public Service Commission are required to be notified within a period of 10 weeks from the date of receipt of their advice letter. This time limit should be strictly adhered to.

2. The Commission has, however, brought to the notice of this Department that even after the lapse of 10 weeks time, the Recruitment Rules pertaining to a number of posts which were advised upon by the Commission are yet to be notified.

3. Ministries/Departments are, therefore, requested to initiate action for notifying the Recruitment Rules as soon as the same are approved by the Commission so that the prescribed time limit of 10 weeks is adhered to.

Subject: Admissibility of Travelling Allowance (TA) and other expenditure incurred while on training by the Government Servants on probation.

Institute of Secretariat Training and Management (ISTM) is conducting Foundation Training Course of newly recruited Assistant Section Officers (DR) and Stenographers (DR). ISTM has received number of references from various Ministries and Departments, requesting for clarification, whether the expenditure incurred by trainee Assistants, now re-designated as Assistant Section Officers, for their boarding, lodging etc. while undergoing Foundation Training, under the aegis of ISTM can be reimbursed to them. Representations have also been received from Assistant Section Officers, through their administrative Ministries in this regard.

2. The matter has been examined in consultation with the IFD(MHA) with reference to the Supplementary Rules 164 and instructions issued by the Government from time to time under the aforesaid Rules, which govern claims of Travelling Allowances while on training by probationers. The rule position is clarified as under:-

(i) No Travelling Allowance may be allowed for the onward journey for joining the training institute;
(ii) No Travelling Allowance may be allowed to the probationers while they are taken for outstation for training activity;
(iii) Probationers have to pay boarding /lodging /transport charges, if any, from their pocket.
(iv) No daily allowance may be admissible.
(v) One side TA may be allowed to the participants while reporting for duty in the allocated Ministry/Department on completion of the Training Programme from an outstation Institute, which are located at Hyderabad, Kolkata, Chandigarh, Shimla and Jaipur, where such training is being conducted by ISTM at present, or any other State Training Institute, which may be identified later, outside NCR.

3. All Ministries/Departments of Government of India are, therefore, advised to decide the claims made by Assistant Section Offices in respect of reimbursement of expenditure by them for boarding/lodging and other transport charges during the period of their Foundation Training conducted by ISTM, in accordance with the provisions contained at para (2) of this O.M. In case, any reimbursement has already been made, the same may be recovered immediately.

4. This issues with the concurrence with the IFD(MHA), vide their Dy. No. 299/Fin.II/15, dated 31.12.2015.

The undersigned is directed to refer to this Department’s OM of even number dated 06.06.2014 and 17.11.2014 exempting a Government employee, who is also a care giver of disabled child, from the routine exercise of transfer/rotational transfer subject to the administrative constraints. The word ‘disabled’ includes (i) blindness or low vision (ii) hearing impairment (iii) locomotor disability or cerebral palsy (iv) leprosy cured (v) mental retardation (vi) mental illness (vii) multiple disabilities and (viii) autism.

2. The matter regarding the scope of ‘disabled’ has been examined in consultation with the Department of Empowerment of Persons with Disabilities. Considering the fact that the child suffering from “Thalassemia” and “Haemophilia” requires constant caregiver support and it would be imperative for the Government employees to take care of their child suffering from “Thalassemia” and “Haemophilia” on continuous basis, it has been decided to include “Thalassemia” and “Haemophilia” in the term of ‘disabled’ defined in Para 3 of the above mentioned OM dated o6.06.2014-

3. The term ‘disabled’ as defined herein and in OM dated 06.06.2014 and 17.11.2014 is applicable only as grounds for seeking exemption from routine transfer/rotational transfer of a Government employee who have disabled child.

4. All the Ministries/Departments are requested to bring these instructions to the notice of all concerned under their control.

Subject: Discontinuation of interview, for recruitment to Non-Executive posts in CPSEs-reg.

The Department of Public Enterprises has been emphasizing from time to time on the need for formulation of proper recruitment and management policies by Public Enterprises which are in conformity with the latest policies / decisions taken by the Government. This requires a periodical review of Recruitment Rules, CDA Rules and Service Rules so that they are in line with the extant instructions of the Government on personnel management.

2. Recently it has been decided by DoPT to dispense with the practice of interview for all Group ‘C’ and ‘D’ posts and non-Gazetted posts of Group ‘B’ category. Accordingly those cases where recruitment rules of above categories of posts specify the process of selection through interview, the authorities concerned are required to amend the recruitment rules immediately.

3. In pursuance of the above decision of the Government, all Ministries/Departments are requested to ad\iise the CPSEs under their administrative control to adopt a revised mechanism of recruitment for the non-executive level posts by dispensing with the practice of interview for such posts by effecting suitable amendments to the existing Recruitment Rules, wherever necessary. In case for any particular post, interview is considered essential, the clearance of administrative Ministry/Department of the concerned CPSE would need to be obtained by the CPSE or alternatively CPSEs may adopt alternate modalities to assess the required skills for, recruitment to such posts in consultation with concerned administrative Ministry/Department.

4. The completion of the above exercise may be done by 31-12-2015 and a compliance report to this effect be submitted to DPE by the concerned administrative Ministry/Department by 07-01-2016.

Subject:- Discontinuation of Interview at Junior Level Posts in the Government of India- recommendation of Committee of Secretaries.

The undersigned is directed to refer to this Department’s D.O. of even number dated 04.09.2015 and subsequent OM’s dated 09th October, 2015, 09th November, 2015 on the above subject seeking detailed information on the progress made/action taken in the matter.

2. It is informed that Secretary (Personnel) had convened meetings on 14th December, 2015 and 17th December, 2015 to review the progress of implementation of the “No Interview Requirement Proposal” and to get the updated status on the decision/progress made by the various Ministries/Departments. Keeping in view the queries raised by the representative of various Ministries/Departments the following is once again clarified:-

(a) The decision to discontinue interview for recruitments is for all Group ‘C’, Group (which are now reclassified as Group ‘C’) Posts and for nongazetted posts of Group ‘B’ Category and all such equivalent posts.

(b) The ‘No Interview Requirement” proposal has to be implemented for all the junior level posts in Government of India Ministries/Departments/attached Office/Subordinate Office/Autonomous Bodies/Public Sector Undertakings.

(c) Instructions issued by the Department of Public Enterprises on 14 th December, 2015 vide OM No. DPE-GM to all Administrative Ministries
concerned with CPSES under them with advice to dispense with the practice of interview (copy enclosed).

(d) The timelines set regarding completing the process of the discontinuation of interview by 31.12.2015 has to be adhered to strictly. From 01 st January, 2016 there will be no recruitment with interview at the junior level posts as mentioned at 2(a) above, in Government of India
Ministries / Departments / attached Office / Subordinate Office / Autonomous Bodies / Public Sector Undertakings. All the advertisement for future vacancies will be without the Interview as part of the recruitment process.

(e) The interviews will be done away even in cases where in the past the selections used to be made purely on the basis of performance in the interview. The Ministries/Departments/Organizations’ will consider revising the scheme for selection for such cases.

(f) It is also clarified that as Skill Test or Physical Test is different from Interview, and they may continue. However, these tests will only be of qualifying nature. Assessment will not be done on the basis of marks for such tests.

(g) In case of specific posts where the :Ministry/Departments wants to continue undertaking Interview as a process of recruitment, a detailed proposal seeking exemption will have to be sent to the DoPT with the approval of the Minister/Minister In-Charge.

3. All the Oentral Ministries/Departments are therefore requested to ensure that necessary action in respect of their Ministry/Department/Organizations are completed within the stipulated time.

A consolidated report with the details of the decision taken/progress made in this regard should also be furnished to this Department at the earliest and not later than 7th January, 2016. Report so to be furnished with the approval of the Minister/Minister In-Charge shall include the details of the name and number of posts where the interview is discontinued and posts for which the exemption has been sought within the purview of the administrative Ministries/Departments.

In another new initiative “Anubhav”, inspired by the Prime Minister Shri Narendra Modi, the Ministry of Personnel, Public Grievances & Pensions has advised officers retiring within a period of six months to leave behind a note or write-up on their achievements as well as outstanding work done by them which could have, according to them, contributed to efficient functioning of the government or any innovation introduced by them which could have led to improvement in work culture.

Disclosing this here today, Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr. Jitendra Singh said that “Anubhav” will serve as a platform for retiring employees to showcase achievements made by them during their service tenure. While the retiring employees can look back with satisfaction and a sense of fulfillment, the written account left by them could serve as a vital database for future improvement, he added.

Ministry of Personnel has, through a circular dated November 5, 2015, sought to reiterate and remind all the Ministries and Departments to follow up this initiative seriously. The Link to “Anubhav” Portal is available on the homepage of Department’s website at http://persmin.nic.in → DoP&T → Anubhav, he informed and added that initially this facility is available only to retiring Central Government employees including Central Secretariat Service (CSS) and Central Secretariat Stenographers Services (CSSS) officials.

Earlier, on the advice of Prime Minister, Dr. Jitendra Singh recalled that DoPT had also introduced a new practice of senior IAS officers who had put in nearly 25 to 30 years of service to revisit the place of their first posting as District Collectors or SDMs and furnish feedback about the change over the years as visualized by them. The DoPT and the Department of Administrative Reforms and Public Grievances (DAR&PG) are infact the Research & Development (R&D) organs of the government and not merely responsible for carrying out only transfers, promotions and empanelments. To this extent, he expressed satisfaction that during the last 17 months of the present government, a number of new reforms have been introduced with regard to recruitment in Services, Pension Department, IAS/Civil Services training and other areas.

Dr. Jitendra Singh complimented Union Secretary, DoPT, Shri Sanjay Kothari and Union Secretary, AR&PG, Shri Devendra Choudhary for their proactive approach which motivated the entire team of officers to carry forward the new initiatives.

DoPT issued an office memorandum regarding the functioning of Departmental Councils and it mentioned that the meetings of Departmental Council are essential as they help in resolving differences between Government and the Staff Side.

The undersigned is directed to refer to this Departments D.O. letter of even number dated 23.07.2012 (copy enclosed) regarding holding of meetings of Departmental Councils regularly with a view to make effective use of Joint Consultative Machinery (JCM) Scheme. Secretary, DoPT, had also vide his DO letters of even number dated 03.12.2012, 26.07.2013 and 17.02.2015 requested to promote this interaction more proactively through regular meetings of Departmental/Office Councils under the Ministry/Department.

The JCM Scheme provides for Departmental Councils at the level of individual Ministries/ Departments, including their attached and subordinate offices. The Staff Side of JCM, however, has been remonstrating that regular dialogue with the Staff Side through the mechanism of Departmental Councils at Ministry/Department level is not happening. Meetings of Departmental Council are essential as they help in resolving differences between Government and the Staff Side.

It is requested that suitable instructions may please be issued to hold meetings of Departmental Councils on regular basis.
