The undersigned is directed to refer to this Departments OM No.22011/1/2011-Estt.(D) dated 27.10.2016 regarding timely and advance action in convening of Departmental Promotion Committee meeting in terms of Model Calendar and to request that advance action may be taken by the Ministries/Departments /and their Attached and Subordinate Offices of the Government of India, etc for reporting vacancy position w.r.t. Direct Recruitment (DR) posts also to the concerned recruitment agencies i.e. Union Public Service Commission (UPSC) and Staff Selection Commission (SSC) etc. for filling up of such Direct Recruitment vacancies in a timely manner.

2. The administration of cadre(s) of the Organized Services of the Union is done based upon the provisions as contained in the Service Rules(s). The policy change(s) in terms of financial up-gradation, grant of promotion, composition of various Committee(s) for promotion, qualifying service in various grades, are brought for the benefit of the members of the Service. It has been observed by DoPT that several recommendations of Pay Commission have not been incorporated in the Service Rules.(Copy of OM is enclosed).

3. In this regard, I am directed to request all the Pr.CCITs(CCA)/Pr.DGITs to undertake revision of Service Rules of Organised Services under their administrative control. I am further directed to request all the Pr.CCITs(CCA)/Pr.DGITs to indicate the time frame by which they would revise the Service Rules of organised Services under their administrative control.

Guidelines on framing/amendment/relaxation of Recruitment Rules on the website – Regarding

Attention is invited to this Department’s O.M. No. AB.14017/48/2010-Estt (RR) dated 31st December, 2010 vide which Guidelines on framing / amendment/relaxation of Recruitment Rules and Service Rules were issued.

In this context it has been decided that before referring any proposal for framing/amendment in the Recruitment Rules of any post in Ministries/Departments and their subordinate and attached office, the proposed amendments/revision in the Recruitment Rules would be put up on the website of respective Ministries/Departments for 30 days for inviting comments from the stakeholders. . Thereafter, taking into account the comments so received, the proposal would be sent to DoPT, UPSC and Ministry of Law for finalisation.

All the Ministries/Departments are, therefore, requested to adhere to these instructions scrupulously. Proposal referred to this Department without following the aforesaid procedure, would not be entertained.

Subject: Simplification of procedure for verification of service- adherence to the revised format – regarding.

The undersigned is directed to refer to this Department’s OM of even number dated 23 rd October, 2013 for simplification of procedure for verification of service and adherence of the revised format of the Service Book prescribed by this Department’s OM No, 17011/1/99-Estt. (L) dated 11.03.2008 whereby the revised format of the Service Book was circulated for being adopted. The said revised format also includes Part V where under the record of verification of service is to be maintained.

2. It has been brought to the notice of this Department that the aforesaid provisions of the OM dated 23rd October, 2013 and Supplementary Rules as also the provisions of the CCS(Pension) Rules, 1972 as referred to in that OM are not being followed. Consequently, the gaps in service verification, get detected at a very late stage when the concerned Government servant is due to retire on attaining the age of superannuation.

3. In view of this and with the objective of eliminating delays in processing of cases of retiring Government Servants, the aforementioned rules and the instructions of this Department are reiterated and it is stated that it may be ensured that the following are strictly adhered to:

(i) The record of verification of service may henceforth be maintained only in Part V of the revised format of the Service Book as per the new format prescribed by this Departments aforesaid OM of 11-03-2008.

(ii) The exercise for ensuring completion of the entries of service verification in the Part V of the new format, in respect of employees who are retiring within five years, may be undertaken immediately, by the concerned administrative authorities and concluded within a defined time frame, as may be worked out by such authority.

(iii) Any gap in the verification of service may be intimated to the employee concerned, and simultaneously appropriate action for ensuring verification of missing spells may be taken by the Head of Office.

(iv) The concerned Government servant may also be informed of deficiencies and gaps as regards missing entries relating to verification of service and the period thereof.

4. The Department of Pensions and Pensioners’ Welfare have also suggested that the administrative authorities, to preclude and to cut down on delays in payment of retiring benefits to Government servants retiring of superannuation, may consider adoption of the following mechanisms and processes:

(i) Annual service verification and intimation to every officer regarding Service Verification Status so that any lapse is timely ascertained and corrective action taken.

(ii) The exercise of Annual verification be monitored by every Ministry/ Department/Cadre Controlling Authority on a quarterly basis.

5. All Ministries/ Departments are accordingly requested to issue suitable instructions to all Heads of Offices/Pay & Accounts Offices for strict compliance of the above instructions so as to preclude any delays in disbursement of retiral benefits of Government servants.

Subject:- Procedure for empanelment and appointment of retired officers as the Inquiry Officers for conducting Departmental Inquiries- reg.

The undersigned is directed to refer to this Department’s office memorandum of even number dated 8th October, 2015 laying down the procedure for empanelment and appointment of retired officers as the Inquiry Officers for conducting Departmental Inquiries by the cadre controlling authorities. The services of the Inquiry Officers would be utilized by the Ministries/Departments under Government of India, State Government and PSUs for conducting Departmental Inquiries against the delinquent officials.

2. Comments/views of Ministries/Departments and State Governments are invited on the procedure laid down in the office memorandum under reference within three weeks from the posting of this office memorandum on the website of this Department(persmin.gov.in).

3. All the stake holders are requested to send their comments on the procedure for empanelment and appointment of retired officers as the Inquiry Officers for conducting Departmental Inquiries within the stipulated period. The comments may either be sent over fax (fax No.011-23092963) or e-mailed at usatl@nic.in.

Clarification regarding stepping up of pay of senior PAs of CSSS w.r.t. their juniors

Subject: Clarification regarding stepping up of pay of senior PAs of CSSS w.r.t. their juniors.

The undersigned is directed to say that several references have been received in this Department from Ministries/Departments seeking advice as to whether the pay of the senior PAs can be stepped up at par with that of their junior Shri Jai Bhagwan, PA of Department Commerce (Supply Division) (now in Ministry of Information & Broadcasting). It has also come to the notice of this Department that many Ministries/Departments have already granted stepping up of pay to their PAs at par with the pay of Shri Jai Bhagwan.

2. The issue of fixation of pay of Shri Jai ghagwan, PA has been examined in this Department. As per DoP&T’s O.M.No.35034/1/97-Estt.(D) dated 04th October, 2012, stepping up of pay is allowed to those officials who got their ACPS benefit prior no 1.1.2006 but are drawing less pay than their juniors, who got it after 1.1.2006 subject to certain conditions. Therefore, in all similar cases, the stepping up of pay of a particular senior who got the ACPS benefit before 1.1.2006 could only be allowed with direct reference to a particular junior who got it after 1.1.2006 and got his pay fixed in terrns of para 2(c) of Department of Expenditilre’s U.O. note No.10/1/2009-IC dated 14.12.2009. Any stepping up of pay is not allowable in a chain-like manner. Shri. Jai Bhagwall got ACP on 01.07.2005 and as such, para 2(c) of Department of Expenditure’s U.O. note No.10/1/2009-IC dated 14.12.2009 would apparently not apply in his case. As such, the pay fixation order No.G-12014/1/2008-Admn dated 09.02.2011 of Shri Jai Bhagwan, PA issued by the Department of Commerce (Supply Division) is not in order.

3. Ministry of I&B were requested to explore the possibility of allowing stepping up of pay to Shri Jai Bhagwan, in case his case is covered under the O.M. dated 04.10.2012. Accordingly, DAVP, Mintstry of I&B, re-examined his case and re-fixed his pay w.e.f. 01.07.2006 by granting stepping up of pay with reference to his junior namely Smt. Promila Bandooni. A copy of DAVP, M/o I&B’s Office Order No.A.20012/07/2012-Admn.l dated 15.07.201.5 regarding re-fixation of pay of Shri Jai Bhagwan, PA of CSSS enclosed herewith.

4. In view of the above, all Ministries/Departments are advised to take further necessary action to accordingly review the stepping up of pay already granted to their PAs in comparison to Shri Jai Bhagwan, PA, CSSS and necessary recoveries of excess amount, if any, be effected. in this regard, from the concerned officials.
