Aadhaar mandatory for pensioners

There is, at present, no proposal to make Aadhaar seeding mandatory for release of pension to the Central Government pensioners.

Eighty-seven percent of Central Government pensioners of all age categories have seeded their bank accounts with Aadhaar number. The remaining thirteen percent, including those Government pensioners of the age of 80 and 90 years have not yet seeded their bank accounts with Aadhaar number. The Government has made efforts to seed accounts of all Central Government pensioners with Aadhaar numbers so as to enable them to benefit from the additional facility of submission of Digital Life Certificate. Public Sector Banks are authorised to enroll pensioners for issue of Aadhaar number, including old and infirm pensioners.

This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in written reply to a question by Shri Natubhai Gomanbhai Patel in the Lok Sabha today.

Anomaly in Pension Fixation as per 7th Pay Commission Recommendations

Anomaly in Pension Fixation as per Recommendations of 7th Pay Commission

One of our regular reader Mr.Visvesvara M K has expressed his views about the calculation of pension for pre-20016 pensioners as per the 7th Pay Commission.

There is an anomaly in pension fixation of pre-2016 pensioners as per 7th CPC recommendations. The 7th CPC has offered two options.

Option I:
Pension calculated by multiplying pension fixed by VI CPC by a multiplying factor of 2.57.

Option II:
Notional pay to be determined by multiplying entry pay under appropriate e Grad Pay and Level taking into consideration number of increments earned in the pay scale from which one retires. 50 % of this notional pay is the pension w.e.f. 1-1-2016.
Whichever pension of Option I and Option II is higher is the pension.

ANOMALY:
If one gets a promotion to higher post in which he serves for less than one year there is no increment earned. 50% of this notional pay as per Pay Matrix of the VII CPC will be pension w.e.f. 1-1-2016 and this pension under Option II is always and always lower than the Pension under OPTION I. Thus, there is no choice for him.

SOLUTION:
It is common to observe that most of the pensioners retired on superannuation after serving in a higher post on promotion will be retiring within a year or so and the increments earned by them in that pay scale is nil or meager compared to the increments earned in the immediate lower pay scale from which he was promoted and this fact seems to have been given a goby. Pensioner who does not earn any increments in the pay scale on promotion which may be only an extension of the lower pay scale should have his increments earned in the lower pay scale counted for calculation of the notional pay which is a part and parcel of the pay scale to which he is promoted.

—————————————————————————————————

Mr.G R Murthy says…
Mr.Visheswara has pointed out that retirees usually serve for least no of years in promotion scale and no of increments earned are few compared to the increments earned in the prev. scale.I presume that the no of increments is calculated as the diff of pay drawn at the time of retirement and the minimum of the pay in that pay scale When a person gets promotion to a higher post his pay in the promoted pay scale is fixed higher at least by two increments so there is no danger of getting less pension than ones juniors. I think the pension varies with the retirement regime of pay commissions for the same number of years of service in the same grade Am I right in thinking so?

Aadhaar-based biometric verification system – Jeevan Pramaan

Government of India
Ministry of Personnel, P.G. & Pensions
Department of Pension & Pensioners’ Welfare

Message

In November, 2014, the Prime Minister has launched an Aadhaar-based biometric verification system “Jeevan Pramaan” to enable pensioners to submit a digital Life Certificate on-line. This is an important step in realising the vision of Digital India. This facility has been provided in addition to the other existing methods of submitting Life Certificate.

2. “Jeevan Pramaan” aims at sparing the pensioners and family pensioners the trouble of visiting bank or any other pension disbursing agency for submission of Life Certificates. It is possible to submit the Life Certificate from personal computers and laptops or by visiting a conveniently located Common Service Centre. Further, banks will ensure authenticity of pension and other payments by linking Aadhaar number with bank accounts and PPO numbers.

3. All the pensioners/family pensioners are, therefore, advised to get themselves and their family members registered for Aadhaar and furnish this information to the Pension Disbursing Authority. This exercise may be completed at an early date so as to avoid inconvenience at the time of submission of Life Certificate in November, 2015.

4. For further details please visit https://jeevanpramaan.gov.in.

The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.

2. The Hon’ble Central Administrative Tribunal, Principal Bench, New Delhi in its common order dated 1.11.2011 in four petitions [OA No.655/2010, 306/2010, 50712010 and 3079/2009] directed that the past pensioners may be granted, w.e.f. 1.1.2006, a minimum pension with reference to the fitment table applicable for revision of pay of serving employees.

3. A large number of representations from pre-2006 pensioners are being received by the Department of Pension & Pensioners’ Welfare for extension of benefits similar to what had been allowed in case of OA No.655/2010 by CAT, Principal Bench, New Delhi.

4. In this context, it is informed that four Writ Petitions were filed in the High Court of Delhi challenging the order dated 1.11.2011 of Hon’ble CAT in four OAs. These petitions were dismissed on 29.4.2013. Subsequently, four SLPs were filed in the Hon’ble Supreme Court over a period of time against the said order of the Hon’ble High Court. Of the four SLPs, the one pertaining to Central Government SAG (S-29) Pensioners’ Association which was first in the series of said SLPs, has since been dismissed by the Hon’ble Supreme Court on 29.7.2013. As the Review Curative Petition against the said order dated 29.7.2013 also failed, the Government of India decided to comply with the order by extending the requisite benefits to the parties involved in the said SLP. As regards the other three SLPs (Nos.36148-50/2013), Hon’ble Supreme Court in its order dated 19.11.2013 issued notice and made the following observation: .

“Learned Counsel for the respondent submits that during the pendency of these petitions the respondent-writ petitioners shall not precipitate the matter by filing contempt proceedings either before the High Court or before the Tribunal. That statement is recorded. “

5. Thus the issue of revision of pension of pre-2006 pensioners w.e.f. 1.1.2006 as covered under SLP Nos. 36148-50/2013 in the Apex Court which have been tagged with Civil Appeal No.8875-76/2011 filed by Ministry of Defence in a similar matter is subjudice.
