Enhancement of retirement age of PSU Bank Officers

The CEO&MD and DMD of Industrial Finance Corporation of India Ltd. (IFCI Ltd.) were appointed with effect from 12.12.2013 for a period of three years. IFCI became a Government Company with effect from 07.04.2015. The Appointments Committee of Cabinet has approved the continuation of CEO&MD and DMD of IFCI Ltd. beyond their age of superannuation till the completion of their contract period i.e. upto 11.12.2016.

This information was given by Minister of State for Finance in a written reply in Rajya Sabha on 1st December 2015.

Changes under Bonus Act

Shri Bandaru Dattatreya, the Minister of State (IC) for Ministry Labour and Employment in reply to a question in Lok Sabha today stated that there is a proposal to increase the eligibility limit and calculation ceiling under the Payment of Bonus Act, 1965.

The minimum wage in the country may not be comparable to those of developed countries owing to differences in exchange rates, purchasing power parity of local currencies, etc. Also under the provisions of the Minimum Wages Act, 1948, both Central and State Governments are appropriate Governments to fix, review and revise the minimum wages of the workers employed in the scheduled employment under their respective jurisdictions. As regards minimum wages in States, there is disparity due to variations in socio-economic and agro-climatic conditions, income, prices of essential commodities, paying capacity, productivity and local conditions. However, as per the available information, a statement showing the range of rates of minimum wages in all the States/Union Territories is enlisted here.

The minimum wages shown for unskilled category for the state of Assam and West Bengal do not include the rates for Tea plantation. However, the rate of Tea Plantation in Tamil Nadu and Kerala are higher than the minimum for unskilled category.

Opposition to notification of OROP

(a) Government vide Ministry of Defence letter No. 12(01)/2014/D(Pen/Pol)-Part-II, dated 7.11.2015 has issued orders for implementation of One Rank One Pension (OROP) for the Defence Forces Personnel. Salient features of the OROP are as under:-

(i) Pension of the past pensioners would be re-fixed on the basis of pension of retirees of calendar year 2013 and the benefit will be effective with effect from 01.07.2014.

(ii) Pension will be re-fixed for all pensioners on the basis of the average of minimum and maximum pension of personnel retired in 2013 in the same rank and with the same length of service.

(iii) Pension for those drawing above the average shall be protected.

(iv) Arrears will be paid in four equal half yearly instalments. However, all the family pensioners including those in receipt of Special / Liberalized family pension and Gallantry award winners shall be paid arrears in one instalment.

(v) In future, the pension would be re-fixed every 5 years.

Personnel who opt to get discharged henceforth on their own request under Rule 13(3) 1(i)(b), 13(3)1(iv) or Rule 16B of the Army Rule 1954 or equivalent Navy or Air Force Rules will not be entitled to the benefits of OROP. It will be effective prospectively.

The Government has decided to appoint a Judicial Committee to look into anomalies, if any, arising out of implementation of OROP.

Government has accepted the demand of ex-servicemen associations to implement OROP, payment of arrears w.e.f. 1.7.2014 and coverage of PMR cases under the scheme upto 7.11.2015. However, Certain ex-servicemen associations have been demanding for changes in methodology for fixation of pension, periodicity of its revision, coverage of future PMR cases, etc.

The Government has decided to appoint a Judicial Committee to look into anomalies, if any, arising out of implementation of OROP.

Minister of State for Defence Shri.Rao Inderjit Singh replied in written form in Rajya Sabha on 1st December 2015 regarding the provision of PMR in One Rank One Pension.

He said that the “certain ex-servicemen associations have been demanding for changes in methodology for fixation of pension, periodicity of its revision, coverage of future PMR cases etc.

Army Flood Relief in Chennai – Update on 07 Dec 2015

The Army has over 61 Teams in Tamil Nadu undertaking Rescue and Relief Operations in co-ordination with the Civil Administration. The teams from Chennai as well as those from Hyderabad, Bangalore & Delhi have rescued more than 19,500 stranded people. Four Army Medical Teams are also providing Medical Aid in various parts of Chennai. So far, the Army has distributed more than 1,00,000 Relief Packets provided by the State Govt and some NGOs besides those from within own resources.

Ten Rescue and Relief teams out of the above effort along with two medical teams of the Army have also been located at Cuddalore and Bhuvanagiri for immediate action as required by the State Administration. The focus has now shifted to relief operations and rendering of medical aid in coordination with the agencies involved including Civil Administration and NGOs.

The Ministry of Labour and Employment has taken steps for drafting the Labour Code on Industrial Relations, by simplifying, amalgamating and rationalizing the relevant provisions of the following three Labour Laws:-

(i) The Industrial Disputes Act, 1947,

(ii) The Trade Unions Act, 1926,

(iii) The Industrial Employment (Standing Orders) Act, 1946.

The Government carried out the process of Tripartite Consultation for drafting the Labour Code on Industrial Relations, where the representatives from Central Trade Unions, Employers’ Association and Central Ministries/State Governments participated and gave their suggestions. Two such meetings for the tripartite consultation on this Labour Code were held on 06.05.2015 and 06.10.2015.

During consultation stage, the draft of the Labour Code on Industrial Relations has also been shared with experts of International Labour Organisation (ILO) who have provided their suggestions on the provisions of the draft code. The provisions of the draft code are under consideration.
